What happens if someone that is over 21 buys someone that is underage a drink at the resturant or at a bar..what would happen?

Then the owner of the restruant or bar will be in trouble. Perhaps the person who serve the alcohol may be suspense from the job or fire. So they should check out their driver license

Youll see these guys.

Yeah, just like what Pomeranian said.

Both the restaurant and patron would be in trouble if reported. Since the over 21 person is illegally serving the underage person with alcohol after they've purchased it, they will be the ones punished, but the restaurant will be held responsible because of their neglilence in checking ID's. It's a stretch, really, but since the law wants to discourage restaurants from playing ignorant, they'll hold them responsible too.

they can be fined.. sometimes shut down.. depending on the circumstance..

And theyre loopholes around it. A kid can ask an adult to buy booze at the liqour store and theyre get it for them. A kid ask me and gave me a $5 i told give me a $20 ill get it for you. And he said no way,,,Fine no booze find somebody else...He said OK,,,,Heres a $20 why i said you gotta pay for my service fee. Well thats the real world. A car mechcanic charge you a labor fee for his service i should charge you a service fee.

That is a crime in the state of Florida. If the child swallows the bottle and dies or gets hurt or hurts someone YOU are liable. Steve YOU go to jail and get sued too. Then the ATF boys come to visit you because you do not have a license to sell liqour. Federal crime. Nice knowing you Steve!

For someone who doesn't like the police, you are doing your best to have a run-in with them. (If I believe all your stories.)

Not only is buying alcohol for minors illegal, it is also dangerous for the health and safety of the kid. It is also a big risk for you because a common sting is to use "minors" to try to buy alcohol.

Anyone buying booze for a minor is playing with fire.

Ok let me tell you this stories.

Back in the Summer of 1997. I was staying home with my baby and my exh came home from errands. As soon as he walked into the house and make a call to the police. Across the street from my house there was a big time trouble. Boy oh boy, I saw 4 cruiser and a cargo van. Cuz my exh told me that he saw a bunch of kids was fighting in the street. As soon the cops arrived the house and I saw a bunch of kids running away from the scene. So the cops was there for about 4 1/2 hrs. I found out from my neighbor telling me that there was 2 adults in the house and they invited bunch of teenagers to have a party with alcohol. So the cops had to call the parents to come get their kids. I see them come and go with their kids. What a sad nite. The 2 adults was arrested for serving alcohol to teenagers and unlicense firearms. So how do you like that serving alcohol to teenagers??

In State of Ohio You can go to jail for selling alcohol to underage, Even if over 21 purchase the alcohol for them, They will also be sent to jail and a fine.

Pomeranian, Dennis and Zesty all said it correctly. :thumb:

A lot of this depends on where you are, but in our city it is pretty tough...

First, the business could be fined and/or lose their liquor license. For a business, this could be deadly. In most cases, the employee that sold it would be fined as well...and would probably be fired from the business.

For the adult that gave it to the minor, they would probably go to jail for the night and face fines and other penalties (not to mention being embarrassed telling this story to a judge).

For the minor, they would get taken into and issued a juvenile citation (if under 18...if over 18, they could go to jail). Under 18, parents would be called and would have to come to the station to pick up little Johnny.

The establishment and the purchaser could also face a lawsuit from the minor's parents too.

My thoughts are with Reba:

Stings like this are popular in our agency.

And if an adult buys liquor for a kid and sells it to them to make a 400% markup?

what if they checked the ID's ... and this person is 21 and above.. but another person isn't 21 yet.. so therefore why blame the restruant if they did? should blame the person who's responsible who gave alchocol to underage... i've seen friends do that often

Actually, the person who bought the alcohol would get in trouble... not the person who served it. Who did the actual serving? It was the person purchasing the alcohol. If I bought alcohol for someone else who was under 21, I would get in trouble... not the place selling me the alcohol. Legally, I can purchase alcohol because I am over 21... therefore, the business isn't in trouble. Illegially, I am giving it to someone under 21... therefore, I will get in trouble.

I was going to point that out, however, there is one problem with the scenario. The original post said Restaurant or Bar so my assumption was that this was being consumed on the premises. If that is the case, then the establishment could get in trouble for it.

Taylor, you mean: 2 men, one 22 yrs old, the other is 19 are sitting in a restaurant. The 22 yr old orders alcohol, presumably for himself. Now it is up to the wait-staff to watch and see who drinks it?

You're sorta right. If it was a bar or club, then they would have stricter responsibility for ensuring that only those who are over 21 can enter or consume alcohol. However, if it was in a restaurant... it might be a different story. They may be given a less penalty or none at all. It's usually where along the chain that it happens. Place served to person over 21... place is fine. Person over 21 served to person under 21. Person over 21 is in trouble. That's pretty much it. Heh!

Keeping it short, JUST DON'T DO IT. Too many people can get in trouble.

I do remember having a topic a few years about about letting your kids try alcohol. Lemme see if I can find it and post it here...
