Should the law give people greater rights in cases of self-defence?

It's the most basic human instinct — the instinct to protect yourself and your loved ones. But the law and the courts don't always agree, which often raises the question: just whose side are they on? So, what rights do average law-abiding citizens have? Say you take a swing at someone or, even worse, take a shot at them. How far can you go? Well, that depends. You could be the one who ends up in court. You could even be charged with murder. But there's a new crusade stirring on behalf of the victims — a campaign for tough new laws that would make self-protection mean just that.

If anyone break in my house and I will have no choice but will hurt the burgalar to protest myself and my family, but I could go to jail for it!!
Also if the burglar break my window and cut his hand, he can sue me for it, what a crazy and stupid laws!!!!!!!!!!!

I think self protection should be legally recognized. How else can we protect our lives and our loved ones'?

Sometimes the law has a hell of a time breaking up fights on streets, usually perpetuated by a need to protect oneself on the fighters' part. But yeah I think it should be different for defending ourselves on our own property.

Anyone selling tazers?

I wouldn't mind having a tazer. However, they're illegal in the state of New York. :(

Not in South Carolina. You will not be arrested for defending yourself or your family from intruders to your house.

Yes, it´s same with Germany law, too.
 
Accord German law. YES! We are allow to defend ourselves to against burglar if they try to hurt us, also on our property or break in our house.

The watch dogs are also allow to hurt them, too if they are on our property or in our house BUT we have to put the warning sign front of our house gate that we have dangerous dogs. That´s their bad luck if they ignore it.

We are also allow to carry the gun with liescne to defense ourselves against murders, burglar, eg. ONLY if they tried to hurt us with weapons.

The criminals can´t do anything to sue us if we hurt them because we do is SELF-PROTECTION.

Your laws sound very similar to the laws here.

I have a license to carry a concealed weapon. I had to take an all-day safety course, pass the firing range test, pass the written test about gun laws and gun safety, have a background security check (with fingerprints), and pay a fee.

For home defense, no license is required to keep the guns in the house. You do get a background check when purchasing guns.

Setting up booby-traps on the property is illegal.

hmm, i wonder which other states in the United States

I do believe in Self-defense, and I think we should be able to defend ourselves. But, it depends on the situation.


The story I am going to tell u is familiar with this situation but not the same... This happened last year on Halloween when ^Angel^ told her soon to be ex husband that we were going to drop the boys off at his mother's house where he was living at and he knew about it for days and had no problem with us dropping the boys off because, we were going to take the boys Halloween trick and treat ... after trick and treating I drove the boys and my sister to her mother in law house I grabbed the kids bags and walked up the door and her mother in law came out screaming at me told me to get off her property and hit and pushed me numeric of times I was like wtf! I was only dropping the bags and the boys off.. while my sister's ex husband and her were discussing something outside with her little boy and then I came to my sister and told her that her mother in law pushed and kicked me and want me off her property and she knew there was gotta be problems so she told me to stay input she will do it. so then she came by the door and i was scared for her at the same time so i had to peek what was going on.. so then my sister told her I don't appreciated you doing that to my sister she only helping out ... her mother in law came over and punched and pulled my sister hair wouldn't even let go.. and i went inside trying to let the mother in law's hand away from my sister I also got hit too she used her temper in front of the kids and I thought that was so uncall for what reasons for all this to happen? and she stated that to get off her property and I told my sister i do not think it is a good idea leaving the boys with her because of her situation she is into so then I told my sister let go to the police dept. but her ex husband refused to let her go so i had no choice to leave on my own and left her behind and got the police dept. well the police was hard to find because it was in the center of the city so i stopped at the gas station made this lady to call the police for me so she did and 4 police cars came around me and pulled out their gun in front of my 4 yrs old and i was like what the heck is going on IM the one who called! and the police told me someone report on me IM like what!!!! so he said that the mother in law called and said you went in the house and hit and punch her and trying to break into her home i was like what!!!!! that did not happen that way!!! so he told me to go to the police dept. So I went there leaving my sister there again...and he took me into this room and sat there for like 15 mins and he came in and asked me what happened so I told him everything and he said that she told him a different story and I was like of course she did! so then he said that he is going to have the other officer to find out what side of story your sister told so there no cheating on what really happened so my sister and her older boy had said the same thing I have said so the police let me go and even told me that he would arrested the mother in law for assault so my sister came to the police dept. told me she got a ticket and i was like for what??????????????????? and she said for being on her property when she said to get off but, I told her you had every right to be there because you were doing what ur lawyer told u to do let ur ex have visitations and he knew we were coming but the ex husband was on his mother side of course because, he was mad at my sister cuz she wanted a divorce. the whole thing was so wrong! then we all went to court the mother in law got away with only a 50 dollars fine even through she gave my sister and I brusies from the hitting I thought the system wasn't really on our side because it was a family matter so they tried to solved it but still i think she could have gotten jail time and fine. :pissed:

I can't beleive when I read your story about Angel's mother-in-law. She must have known that you & Angel are not strangers or intruders to her! It look like that she only do is "purpose" because of those situation between Angel & her ex-husband.

It look that mother-in-law need a professional help!!!

Yes, what you doing is right to keep your boys away from her & her temper condtion.

I'm disagree what police doing to you is pulled out their gun front of you & your boy because you done nothing, also even weapons. They should ask you polite to come to Police station with them.


You're lucky that you has witness to state that you didn't anything to her. Without withness, you are nothing.

Now you know how the ex husband get his fists from? his mother!.. She is a bad role model for her children.. as I heard they had a bad past. If she would have gotten the help she needs before her children grew up then none of this would have happen... But, too bad She still acts that way. She doesn't like my sister because she filed for divorce from her son...Who fault is that? Hers! :mrgreen:

Yeah, children brought up watching their fathers beat up Mothers, and they will carbon copy to keep it repeat to their future spouses!

I agree that was a frightening terrible experience. But you also must see it from the police viewpoint. At the time they received the call, they didn't really know what to expect. If they are expecting to confront a violent emotional person, they need to be prepared for protection. The most dangerous situation for a police officer to approach is a domestic disturbance. Family fights kill more police officers than any other situation. So they must be very careful. The police didn't know whether or not Cheri had a gun until they could safely check.

I think the person/persons to blame for the awful situation is the mother-in-law and the ex-husband. They set up the bad situation, and pulled the police into it.

Again, my sympathy to Cheri, Angel, and your family for this terrible experience.

Anyways, I do believe in self-defense too but sometimes, I wonder if I went a bit too far, I might be charge with murder...who knows..

I don't like how the laws works anyways....Justice sometimes isn't enough to protect us.....that's another reason why we should be able to defend ourselves.....
