News - Man Sues Florist for Revealing Affair



HOUSTON (Aug. 10) -- A married man is suing 1-800-Flowers for $1 million for revealing that he was cheating on his wife.

Leroy Greer said in a lawsuit filed this week in a federal court in Texas that he bought flowers for his girlfriend through 1-800-Flowers. He asked to keep his purchase private.

Greer said he was referred to the company's privacy policy, which states that customers can ask 1-800-Flowers not to share personal information with "third parties."

But, the lawsuit says, 1-800-Flowers sent a thank-you note to his house and his wife saw it. When she called the company, 1-800-Flowers faxed her a copy of the receipt from Greer's secret purchase.

The receipt revealed that Greer had sent another woman a dozen long-stemmed red roses, along with a note that read, "Just wanted to say that I love you and you mean the world to me!" according to court documents.

The couple was already going through what Greer's attorney described as an amicable divorce.

After learning of the affair, Greer's wife asked for a $300,000 divorce settlement in addition to child support, said Kennitra Foote, Greer's attorney.

"That thank-you note is going to cost him money," Foote said.

Greer is asking for $1 million for breach of contract and deceptive trade practices.

"This is not a moral issue," Foote said. "The issue is, is 1-800-Flowers in the business of causing divorce or are they in the business of sending flowers and sticking to their privacy policy?"

A 1-800-Flowers spokesman said the company does not comment on pending litigation. In a statement, spokesman Steven Jarmon said, "We take all matters relating to our customers seriously; however, we are not responsible for an individual's personal conduct."

S'pose I'm the judge, this is how I would 'handle' this (maybeee...:lol:):

Award the man that full amount of the lawsuit based upon breaking the terms for privacy and possibly for breach as well. However, all he will be allowed to have is just enough to cover for the refund of the purchase (roses)...and remaining full amount then be turned over to the spouse (wife) for mental anguish, suffering, loss of trust, loss of companionship, support...etc., etc.,.... ;)


Anyhow, sure hope this case will get thrown out...and no monetary award given as well.

Well cheating is bad, but ruining his personal business is wrong too. The man and the florist both did wrong things, that's all. That man deserve to be dicroved and that florist deserve to be sued, that's my opinion..
 
hmmm, the first thing I think of is if he wasn't having affair wouldn't this whole thing never happened? His fault for cheating and just not owning his own mistake.

I guess he was too stupid to use a P.O. Box for his "personal" business.
 
im sure mostly married man need know not going see another woman when he married! and im sure the wives need approves where purchases that flowers for who?!?

im sure the wives always rights about soon to be as ex-husband for getting divorces and getting money.
 
Unless the CC have wifes name so the wife have right to know what her hubby purchased? correct?? he is still wrong to send flowers to other lady. period.
 
I'm curious to know how many other customers receive thank you notes for conducting business with this company and if it's standard practice to do so?

On the other hand, we have a man who wants to help populate the earth by committing adultery on his wife, whom he promised at his wedding to forsake all others and hold true to her in sickness and health, til death do part. Was there anyone who held a gun to his head telling him to have this affair with this whore? Why is he blaming someone else for his own mistakes? In addition, for keeping this "secret," was there a written contract saying that the company would hold this private and not reveal it to anyone? His wife also has rights and she was entitled to know what the note was about, as the money he spent on flowers came out of her pocket, too.

If I were the judge, this is what I would say:

After singing this song, I'd dismiss all charges and place judgement in favor of the wife for full amount. Then I would laugh at him. :laugh2::bowlol::bowlol::bowlol:
