BOSTON (Reuters) - A federal judge on Tuesday ordered Massachusetts officials to pay for a convicted murderer's sex change operation, ruling that the state had violated the inmate's constitutional rights in denying the procedure.

In a 126-page order issued in Boston, U.S. District Judge Mark Wolf found in favor of Michelle Kosilek, who sued the Massachusetts Department of Correction 12 years ago to force it to provide him the surgery while imprisoned.

Wolf said senior corrections officials engaged in patterns of "pretense, pretext and prevarication" to deny Kosilek the treatment he was entitled to and which had been recommended by department medical staff. The court had previously ruled in 2002 that Kosilek should at least be evaluated for the surgery.

Although Kosilek legally changed his name -- he was formerly Robert Kosilek -- and has been taking hormones that have caused his breasts to grow, the judge used male pronouns throughout the order. He is incarcerated in a state prison for male inmates.

Kosilek, according to court records, has suffered from gender identity disorder since he was a small child. He married a counselor he met while in drug rehabilitation, but murdered her in 1990 after she caught him wearing her clothes.

He was convicted in 1992 and sentenced to life in prison without the possibility of parole.

"In this case Kosilek has proven that he still has a severe gender identity disorder. Although female hormones have helped somewhat, he continues to suffer intense mental anguish because of his sincere and enduring belief that he is a female trapped in a male body," Wolf wrote, citing the U.S. Constitution's Eighth Amendment protection against cruel and unusual punishments.

Wolf noted that the corrections department had fired a doctor who recommended that Kosilek receive the surgery and had hired a social worker who was known to consistently recommend that inmates did not have the procedure.

Wolf did not explicitly set a timetable for Kosilek's surgery, saying it was up to the state to determine who should perform the operation and in which facility.

A spokeswoman for the Department of Correction said it was reviewing the decision and exploring the possibility of an appeal.

What's odd news. :ugh3:

Sex change operation is elective procedure (cosmetic), not part of life threatening or required to maintain the life.

How on earth is a convicted killer entitled to anything?

It's too bad his victim wasn't entitled to live out the rest of her life.

Maybe his prison buddies will take up a collection to pay for his surgery, as long as he stays in general population after.

The whole thing is ridiculous.

You means when he becomes she after totally sex change surgery so she has to stay in male prison?

Massachusetts is very transgender friendly state and if he-->she has fully sex change operation, including vaginal and boobs so she will have transfer to female prison or special cell.

My proposed scenario would never really happen. It just goes to show how ridiculous the whole thing is.

I think the whole thing is a ploy to get out of a male prison for life I also think its stupid for any judge to even consider allowing something like that to happen he is in prison not a luxury hotel
 
I'm wait for someone with gender identity disorder or transgender to make opinion about this article because they have different feeling than us do.

Whether someone is transgender or not, the solution is don't commit murder and end up in prison.

I know but I just want to hear from someone with transgender or gender identity disorder to make statement because they don't share same feeling/thinking as non-transgender people like me and you. Sometime, my post #2 could offend someone who are transgender or gender identity disorder.
 
What a total and ridiculous waste of taxpayers money. He is in prison for goodness sake! No elective procedures should be allowed at all! Prison is meant to be punishment. Unbelievable????!!!!

You have to strip the constitution rights for all prisoners.

The only right he has is to humane treatment, food, clothing & shelter! By humane treatment it means his basic medical necessities are met!

I AGREE WITH YOU! If they can strip a victim of their right to safety, decent life, etc., then why should they have rights at all?

I completely agree. While I totally respect the way people live their life (whether it be straight/transgender/gay/whatever), you lose rights when you go to prison. Anything beyond basic healthcare (and life-threatening medical situations) is just ridiculous.
