As per the 12th Amendment to the Constitution, the decision will be made by Congress. As the electoral votes are officially read on the 6th of January, it will be the Congress elected this coming November that makes the decision.

The Presidential race is determined by a count of the state delegations, all 50 of them. Each state gets one vote, regardless of size. A given state's vote is determined by a sub-vote within each state delegation. (At-large Representatives are straight forward.) Whoever wins 26 or more states on a given ballot is President.

However, the Vice-President is determined by the Senate, where each Senator has one vote. Whoever wins that vote is Vice-President. Thus it is possible that the President and Vice-President would be from different parties, depending on how Congress is organised and how each member votes.

Thanks Jess...I figured it would be decided in Congress also, didn't know there was a separate Veep vote.

Has there every been a tie? I dont recall being taught that there has been a tie in history of USA.

If we have another voting crisis, I wonder which state it will be.

In 2000, it was Florida.

In 2004, it was Ohio.

The only U.S. election that resulted in a tie was in 1824 between Quincy Adams (victor) and Andrew Jackson.

Also, due to a technicality, the election of 1800 resulted in a tie between Thomas Jefferson and Aaron Burr, Jefferson's Vice Presidential running mate. After several months, the House of Representatives certified Jefferson as the winner, but the confusion prompted a clarification of voting procedures which resulted in the 12th Amendment to the Constitution.

Re: a tie with the electoral vote. If the electoral vote turns out to be tied then the House of Representatives decides who will be the President. This is explained by the 12th Amendment.

However, unlike the electoral college where population provides more votes, each state only gets one vote.

For instance, California with 53 representatives will only have one vote represented.

Whoever gets 26 votes will be the next President of the United States.

Pennsylvania. They also have a high number of electoral votes to be had. They also are very much a republican state usually. But, I really don't want to see another election drama. We've had enough of that already!

I guess I don't see the humor in it. I live in FL, though. We lived and breathed the crap until it was all settled. I don't want to go through that again any time soon.
 
wow, Obama´s poll is 2 times higher than McCain´s poll... :shock:
 
Obama is currently leading in Florida 47% to 45%.

Sometime within the last few days, I heard that McCain was gaining ground. Not sure what all these means, but you can bet your sweet life I'll be glued to the election coverage Tues night!
