What would you do if your Landlord refused to repair a gas leaking and you as a tenant have no heating system?


It has happened to me, in fact after received a phone call from a daycarer, stating that there was some smell of gas odors, and the gas company came out and immediately shut off all gas line to both houses, mine and next door, and I was told that the Landlord has to repair the condition within 72 hours done by professional certified by state or local laws, he threw a fist about paying so much to repair the gas line under ground, so he failure to repair that in 72 hours and now that we are not having no heating system and it's 22 degrees outside, What am I gotta do? If I vacating the property does that mean he has to pay the hotel fee? Landlord supposed to to supply hot and cold running water and a working heating system at all times. I am planning on buying an electricity cooking item for warming up some hot water for bath and cooking too and a electricity heater too. I just hope we don't freeze to death, I'm more worried about my kids safely than myself here. :(

Oh dear... Why don't you try contact your local City Hall and ask for Tenant Acts Rights?
Do you have paper proof that Professional cerfited paper information which your home isn't safe and needs repair within 72 hours ? If yes.. Perfect show the Tenant Acts Rights and explain what happend situation issues your home isn't safe to staying due gas leak.
Would be great benefits Tenant Acts Rights will make action for you contact authorization quicker.. Hope so, would be great helpful ?

If Landlord refused their action.. Go back to Tenant Act Rights and nofity them about it again and what will do next due weather isn't good for your children condition pretty freezing up.
Tenant Act Rights can arrangements lawsuit for you... includes you'll be part of lawsuit to landlord which not made their action repair the problem within before 72 hours.

If contuine refused, so I guess so you shall move another location.. (pain ass) Yes I know you feel really kind unpleasant near the winter time due moving..

Dang.. I would kick his butt..

But now. you need to focus on your family and yourself safety and sake..
my advices.. call Salvation Army or Red Cross.. to see if they can help with the shelter.. for just temporary...

Or.. go over your friend's place or sister? I would get out of there.. I dont want freeze our butts off and make lawsuit to your landlord for not supporting you guys.. for the shelter.. hes being not fair for you guys PLUS he should have insurance for the house .. if anything happen it should covered by insurance.. SMH.. then why he should throw sissy fits..

If we live closer.. I would provide our place for your warmth stay.. :/


I am praying for you guys to find better place for now.. and change landlord's mind to be kindress and caring about his own tenants.. smh..

It's exactly same here in Germany but I would like to add bit more...

I think it's not good idea to stay at hotel to get Landlord to pay because it will cause more anger and hassle in Cheri's family life.

I would advise you to reduce your rent until repair is done. I know the Tenants rights because I had been through myself before. First of all is check with Tenant Acts Rights first like what GalaxyAngel suggest before you prepare to do something. I beleive the people from Tenant Act Right will tell you how many per cent you have to reduce your rent until the repair is done. If Landlord do something to upset you then go to Tenant Act Right to file a lawsuit. You need to pay nothing extra. Good Luck :hug:

I would reduce my rent to compare electricity use when I were you to keep the children warm.

Your landlord is something else sis, I've told you from time to time to move out, your landlord makes too much lame excuses by fixing the problem you may be having....If he complains to much by saying how much he spend $$ on repairing the things in your home, then why is he the landlord?.....

U need to call the city again, tell them that the landlord refused to fix the gas line, have them to do something about it, you got to fight sis, otherwise you will be stuck without any heat during the cold winter....the landlord needs to get his act together and take the responsible as a landlord by repairing whatever problems the tenants may have...

I've never experiences anything like this from any of my landlords when I used to live in several apartments, it looks you got a landlord from hell who refused to do his job as a landlord but complains too much!!...I personally think it time for you to move out sis, don't you agree?...

I agree with you ^A^... the landlord is feeding himself with tenants' money and does not care for others. He expect nothing will happen unless one do something against him as to teach him a lesson.
 
It wouldn't hurt to make aquick call to the gas company and let them know that the landlord is putting your family in jeopardy.

Actually, the above was just an excuse to go off-topic to welcome the twins back!! :applause:
 
Call your hometown board of Health. I did call them, they do inspection the house immediately and force landlord to do repair. Board of Health will report State of Ohio to do inspection the house if it is safe or not.

Landlord is responsbility to pay you and children to stay in the hotel until he is repaired all the house. It is against the law.
 
I made a few calls today to Dominion Gas, the City and the landlord.

The Dominion gas said it's out of their hands because they only shut it off for safely reasons because of gas odor, there a leaking somewhere in the pipe underground in order get my gas turned back on the Landlord has to hire a private professional certified by state to repair the gas line and then they will come out and turn it on after the job is completed.

I talked to the City of my hometown, and the Mayor's office also and he said that a few people came by the house yesterday to located the lines, and that the Landlord has to get a permit from the city to have the professional certified to dig underground to the gas line pipe to find out where the leaking is located at, then they can do repair It's gotta take a few more days because it's a big job and the City suggest me to stay with a family relative until the job is compete and I told him that the Landlord refused to repair the problem, the Mayor said he doesn't have no choice, the city said if he refused to fixed before this week is over, the landlord will be charge a fine by the City and he would have to appear to court to explain why he refused to repair the gas leaking.

Then finally I talked to my landlord by phone, at the begin he started yelling about how that they have to come out and dig through his brand new drive-way that he had re-done two years ago, and that cost him tons of money and I was like, so you're upset that they have to dig a hole in ur brand new drive-way? I didn't know that it was that important than worried about the gas leaking. Good Grief! He's is such a pain to communicate with. I asked him again are you going to hire someone to repair the gas leaking? He said, "Do I have a freggin choice? Once this all is over, I'm gotta raise your rent up". Oh geesh! :roll:

Good Cheri for calling the City cuz that the only and best way to kick the landlord to get it fix. Too bad if the driveway is new. It is for the sake of children and adult to stay warm. Raising the rent is out of the question and you should explain that to the city of his action. Then maybe but maybe it wont happen to raise the rent. If he does then you might consider to move a safer place not only that get a information about the landlord to see if she/he is a good landlord.
 
FYI, what your landlord did was clearly violated the law! he can be heavily fined for refused to do provide adequate heat. The best bet is contact your local building inspector, or some case some city have their own branch of office like here we got whats called "NET" offices they do community relations and they can fine landlord for refusing to have the heat fixed within 24 hours!
Whats more, this landlord is real stupid, what he had done can do him MORE damage. Once pipe freezes in his building, he will have to deal with HUGE plumbing expenses!!! It is NOT worth for him to refuse to fix the heat. STUPID STUPID landlord!

Oh dear, Cheri...I'm sorry you and your boys had to go thru this! :tears: I surely hope that your landlord will get repairs done fast as it's really cold in Ohio right now. Put on warm sweaters, and put lots and lots of blankets/comforters on your and your sons beds meantime. Please do keep us ADers posted!
