Uh oh... looks like there's a lawsuit against Apple for bad advertising. Apparently, their iPhone 3G don't really have 3G plus they don't work well with other wireless services except AT&T.

$5 Million Lawsuit Charges Apple With Fraud Over 3G Speeds

A new lawsuit filed this week against Apple and AT&T charge the companies with a host of offenses related to the speed of the 3G network and the performance of the iPhone.

The lawsuit, brought by San Diego, California resident Peter Keller, and filed in the United States District Court, Southern District of California, accuses the two companies of Negligence, Breach of the Express Warranty and Implied Warranty of Merchantability, Fraud and Deceit, Negligent Misrepresentation, Unlawful Business Practices, and False and Misleading Advertising.

Keller says Apple markets the iPhone 3G because of its speed, but the phone and the network do not live up to the advertising that Apple and AT&T have given to it. The lawsuit also says that users only experience 3G connectivity a fraction of the time.

"Consumers are unable to choose any other network or carrier when using their iPhone 3G," the lawsuit reads. "Through this joint agreement, Apple and AT&T have engaged in a collaborated scheme to deceive plaintiff and other consumers, since the iPhone 3G and AT&T 3G Network is faulty and rarely provides 3G connectivity to its customers."

The lawsuit seeks corrective labeling and advertising on the iPhone 3G, a constructive trust on all monies obtained by Apple and AT&T for the iPhone 3G, and punitive, compensatory and statutory damages.

This isn't the first lawsuit Apple and AT&T face over the speed of the 3G network. In August, an Alabama woman sued the companies for failing to deliver on the promise of fast speeds on the iPhone 3G.

ROFLMAO! Poor Apple...In one weekend, they got hit with the Blackberry Storm on the LARGEST 3G network in America (Verizon) and now this lawsuit...

Makes me feel so good to be giving Steve Jobs a nice wedgie this weekend  That was by telling him he can take his iPhone 3G and shove up his ass by buying the Blackberry Storm instead of the iPhone 3G.

Stablescort, he'd be pwned for sure, if he ACTUALLY bought a blackberry ;)

I believe that victim been copy the idea on lawsuit on 3G speed from Europe.

Well, my phone loads web page contents MUCH faster than the iphone 3g.

Nope, it's much older than that lol. It's AT&T 8525 running on Opera Mini, the pages look pretty much exactly like you see on the desktop version.

I did research on the AT&T/Cingular 8525.

Cingular 8525 live shots (Phone Arena)

Did you know it was an ancestor to the HTC Touch Diamond? rofl.... Maybe I should trade my EnV in for a HTC phone for my ex wife so she can keep contact with me BUT Im not buying her a Blackberry. It's like a Ford vs Chevy war with smartphones lol...

It is, yes. I am aware of that. The new one is HTC Fuze which AT&T has in their store and it was released recently to replace the AT&T Tilt.

Really IMO AT&T should sell them as HTC instead of branding these phones with their own name. But o well Verizon does sell HTC phones as their own lol.

Damn we getting a bit off topic roflamo!

Yup, I just ignored to some of silly post.

It looks like consumers have no common sense and they don't know how to contact Apple about report the issue, none of cases have been win yet, file a lawsuit against Apple is waste of time.

All of issues that you specified has been fixed via update and I hope that judge will dismiss all of cases.

It doesn't means BB Storm will beat iPhone 3G because of that, even iPhone still sell like hotcake.
