Exactly. And the charge of hate crime is reserved for those cases when motive is relatively obvious.

The motive is different in your second instance. That is what you guys don't seem to grasp. There is a clear distinction in the criteria used to define a hate crime under the law.

All kidding aside, if they taunt him for his sexual orientation while beating him, yes.

Women are a marginalized group. I am referring to the fact that you will never have to be concerned with loosing your life because of the color of your skin or your sexual orientation. Therefore, it is quite comfortable to sit back and deny justice based on what you will never even have to consider for yourself.

Right. You cannot take things out of context. Context is important here. Just saying something happened: Kid A beat up kid B. tells you nothing about the motivation or the reasoning. Investigation may reveal a line of hate spewing from kid A against all kids like B.

No one is proposing to just label all white against black crimes as Hate Crimes. But if you look at the statistics of criminal behavior you will start to see trends and this is why we have laws against Hate Crimes.

If you see inner city Hispanics getting beaten up all the time, it's a pretty safe assumption that there is bigotry taking place. And when another crime of this nature takes place, it's logical to start out looking at it as another Hate Crime. Sometimes investigation reveals simple robbery or such. The Hate Crime laws is used to reduce the incidents of hate related crime. We don't punish people just because we feel they deserve it. We punish people in the hope that we can reduce violence in the community. I think this point often gets lost.

You know that for a fact, do you?

Did you know that there are some black people who kill white people just because they are white? It happened in my locality a few years ago. They even confessed that was the reason that they kidnapped, raped, and killed her. It was even premeditated. So, yes, it does happen. White women do lose their lives because of the color of their skin.

None of us has any guarantees that we will be free of a criminal attack during our lifetime.

I wish I had states on that. You are going to have to agree or disagree with me on the stats.

Your scenario... the "man 1" is not attacking "man 2" because of the penalty of doing so. Which supports my hypothesis that hate crime laws deter/reduce hate crimes.
