A hate crime....

She says from a position of white privilege that guarantees she never has to worry about a hate crime being committed against her. That is what the privileged designation is all about. Easy to sit back and determine for others when you never even have to consider that you might loose your life based on nothing more than the color of your skin or your sexual orientation.
That's funny. I thought you included women in your marginalized groups. :hmm:

When they used those words, their motives are no longer assumed. When those same two kids beat the same gay kid over the head and take his wallet, is this a hate crime?

Exactly. And the charge of hate crime is reserved for those cases when motive is relatively obvious.

The motive is different in your second instance. That is what you guys don't seem to grasp. There is a clear distinction in the criteria used to define a hate crime under the law.

If the guy's name is Twinkle, no.
All kidding aside, if they taunt him for his sexual orientation while beating him, yes.

Women are a marginalized group. I am referring to the fact that you will never have to be concerned with loosing your life because of the color of your skin or your sexual orientation. Therefore, it is quite comfortable to sit back and deny justice based on what you will never even have to consider for yourself.

That is not an assumption. There is evidence.

Right. You cannot take things out of context. Context is important here. Just saying something happened: Kid A beat up kid B. tells you nothing about the motivation or the reasoning. Investigation may reveal a line of hate spewing from kid A against all kids like B.

No one is proposing to just label all white against black crimes as Hate Crimes. But if you look at the statistics of criminal behavior you will start to see trends and this is why we have laws against Hate Crimes.

If you see inner city Hispanics getting beaten up all the time, it's a pretty safe assumption that there is bigotry taking place. And when another crime of this nature takes place, it's logical to start out looking at it as another Hate Crime. Sometimes investigation reveals simple robbery or such. The Hate Crime laws is used to reduce the incidents of hate related crime. We don't punish people just because we feel they deserve it. We punish people in the hope that we can reduce violence in the community. I think this point often gets lost.

You know that for a fact, do you?

Did you know that there are some black people who kill white people just because they are white? It happened in my locality a few years ago. They even confessed that was the reason that they kidnapped, raped, and killed her. It was even premeditated. So, yes, it does happen. White women do lose their lives because of the color of their skin.

None of us has any guarantees that we will be free of a criminal attack during our lifetime.

I'm sure prosecutes take into account the likelihood of conviction before attempting to charge someone with a Hate Crime. I highly doubt that hate crimes has increased the cost of prosecuting crimes, especially when you consider that hate crime laws has impacted social behavior in a positive way (we talk a lot more about hate crime now than ever before - more people are aware of how their actions relate to their bias)

 I would love to see stats on that.

Man 1: Dude you are lucky
Man 2: why do say that?
Man 1: Well I was just about to punch your lights out but then I remembered I can't because I hate you. Whew that was close.

Comes close to verbal assault.

Heck, they might even beat you for wearing a SF Giants' jersey if they hate the Giants. Ask Brian Stow

I wish I had states on that. You are going to have to agree or disagree with me on the stats.

Your scenario... the "man 1" is not attacking "man 2" because of the penalty of doing so. Which supports my hypothesis that hate crime laws deter/reduce hate crimes.

And it was sarcasm. :) Since there are no stats to back you up, I will disagree.

That they are sinners.
We are all sinners. They aren't singled out. One hundred percent of earth's population, past, present, and future are included. I'm included.

If anything, that's being inclusive, not exclusive.
