NEW YORK (Reuters) - A New York lawyer is suing Delta Air Lines for $1 million, saying his family vacation turned into a nightmare after they were stranded in an airport for days and treated disdainfully by airline employees.

Richard Roth, who filed the lawsuit on behalf of himself and his mother, said he planned the Christmas 2007 trip to Buenos Aires to celebrate his mother's 80th birthday. She had grown up in the city, but had not returned in years, he said.

Instead, Roth, his two teenage children, his wife and mother spent three days in airports, went days without their luggage, were treated rudely by airline employees and were forced to spend $21,000 on unused hotel rooms in Argentina, replacement clothes, and other costs.

"Through its gross negligence, malfeasance and absolute incompetence, Mr. Roth holds Delta responsible for ruining his vacation," said the lawsuit, filed in New York state court.

Delta Air Lines Inc had no immediate comment.

Roth said that he has been in touch with Delta about getting reimbursed, but was repeatedly rebuffed. He told Reuters on Wednesday filing the suit was a last resort.

After the initial flight from New York was delayed by more than two hours, the family was not allowed to board their connecting flight in Atlanta, Roth said.

A Delta employee "literally walked away chuckling that he had left them stranded," he said.

After waiting in the airport for hours, Roth was told the next available flight would depart more than two weeks later.

He then booked a flight through a different airline and arrived in Argentina three days later than planned. The family was not reunited with their luggage for more than five days.

"Suffice it to say, Mr. Roth's elderly mother was a mess. And she has been suffering ever since. The kids are all upset. And it was Christmas Eve. Mr. Roth had spent one-half of his vacation in Buenos Aires chasing Delta and its incompetent representatives," the lawsuit said.
 
:roll: Lawyer needs to grow up and make sure that the country he goes to does, indeed, have airline service. Hope he doesn't get one dime and blame himself for his vacation. Get a job!
 
How can one spend $ 21,000 dollars in that short amount of time?

They were forced to spend $21,000 on unused hotel rooms in Argentina, replacement clothes, and other costs. Let's see - Parents + 2 teens + mother... I'm guessing medication expenses, food, airline tickets, taxi fares, hotel amenities, what else...
 
Something's amiss...what caused their delay in the first place? Why weren't other passangers of the same flight affected also?
 
Hmm, There's not a lot of information provided in the article.

I think the request of 1 million dollars is kinda far fetched but, I have to wonder what really happened in the first place to cause this nightmare to begin? There's got to be more to this than the media is telling.
 
dang. i usually ask for free meal from airline if they dont meet what i expectation. Easy way out. LOL. Just be a smart mouth.
 
Sue for $1 million is too extreme. IMO

I think the lawyer want % of $1 million profit if the couple wins at court but ... do they have money to pay % of $1 million off to lawyer's expense if they lost at case?


 
When they arrived at the gate, however, Delta agent Ralph Damour told Roth "the flight had already taken off," the lawyer claims.

When Roth's son pointed to the plane outside the window, Damour said, "It has not left but you cannot get on," the suit says.

"Damour, in an obnoxious, rude, and totally disrespectful tone, said: 'The pilot is not in charge here. I am. All the pilot does is fly the plane,' " according to the suit.

The plane sat at the gate for another 20 minutes before it took off - without the Roths.

That's just plain vicious.

When the airliners screw up, they totally, completely, massively screw up. It would seem, like many non-airline companies, that too many airliners would hide behind bueracracy and policies rather than accept responsibility.
 
Airlines do screw up which cause a domino effect, which is sad and a big hassle for travelers.
