Kentucky bill would force sex offenders to register screen names

FRANKFORT, Ky. (AP) -- Convicted sex offenders could be charged with felonies for not registering their Internet screen names and other electronic identities under a bill pending in Kentucky.

The legislation, similar to a bill pending in Congress, is intended to give law enforcement authorities a way to trace the online activity of sex offenders, said state Sen. Ray Jones, D-Pikeville.

Jones, the bill's sponsor, said he wants to address the national problem of online predators targeting children with virtual anonymity.

"Kids have access to the Internet at school, at home, when they go to a friend's home," Jones said Thursday. "We have to try to stop child predators from using the Internet because it is probably the single biggest risk for children."

Under the Kentucky legislation, convicted sex offenders would face one to five years in prison for the first violation, and five to 10 years for a second.

Under the federal legislation, introduced last week, social networking Web sites like MySpace and Facebook would have access to a database of sex offenders for checking names and addresses against public profiles. It would require convicted sex offenders to register their e-mail addresses and other online identifiers with federal authorities. The information would not be released to the public.

Adults who misrepresent their age to a minor with the intent of sexually abusing a child could be prosecuted and sentenced to up to 20 years in prison under the federal legislation.

I think that law is a wonderful idea but however I am still kind of skeptical about this. Just how effective will it be? There are alot of people changing their e-mails address constantly and it is hard to keep track of which email address they use or not.

Also, I have to wonder, Would they have the money and the time to track each and every one of these sexual offenders from the on-line activities? I am aware that the police, government agencies, so and on are tracking them by their on-line activities but however, it is still not enough because they (the police, agencies, etc) are already overwhelmed with so many other on-line activities that they need to keep track of.

This should be interesting and I am curious how it will turn out down the road.
 
Very good question Jolie, I wondered too, Yep it would be very interesting, Is Kentucky the only state that started on this new bill or has any other state done it already? I haven't heard, have you? ;)

I have no idea if other states has followed up on this bill and made it a law over there but it should be worth looking it up. I haven't heard anything else about other states doing the same thing but I believe there are some states that has a bill which is almost the similar to the bill we have here in Kentucky. If other states hasn't made a law like this then Kentucky would be the only state to do that.
 
West Virginia has a law that requires RSO's to register their email addresses and screen names. Virginia is also considering that plan too.

Virginia’s attorney general said Dec. 11 that he will propose new legislation requiring convicted sex offenders to register their e-mail addresses and instant messaging screen names with the state’s sex offender registry.

Under the proposal, law enforcement agencies would allow social networking Web sites, such as MySpace, to access a new database of e-mail addresses and IM names to monitor users. If such sites find a registered sex offender’s e-mail address or IM name, they can ban or block that person. Virginia is the first state to propose such a measure, officials said.

“We require all sex offenders to register their physical and mailing addresses in Virginia, but in the 21st century, it is just as critical that they register any e-mail addresses or IM screen names,” Attorney General Bob McDonnell said in a press release.

“This is not a foolproof approach, as we all fully realize how easy it is to get new e-mail addresses,” he added. “But by requiring registration and by making the penalties for failure to register the same as those for failure to register physical and mailing addresses, we will take another positive step toward protecting children online.”

IMO it may be a lot harder to enforce the proposed law in Ky as a sex offender can make 2 screennames and give the cops only one address as a "red herring" and use another address in secret.
 
Nice idea in the scheme of things, but I doubt it would work because sex offenders particularly paedophiles always find a loophole in laws that concerns them.

I do hope it'll work. But where will they get the funding to pursue this law once it's implemented if it does?

It'll mean more jobs for people investigating this and pursuing the offenders, which is good, however it'd mean they'll need a bucketloads of money in order to make this happen.
 
It sounds great but I am still bit skeptical about this.

I debated with agree/disagree mostly in Alex's thread "19 year old guy has sex with 15 year old girl".

Would the law force "sex offenders" to register screen because they legal age 18) have sex with 16 years old (minor age accord US law) in the past?

I'm for who are being force to have sex, rape, child porn., etc. but legal age sex with minor? I don't agree to have the law to label legal age as sex offender who have sex with minor age because they did is not rape, prevert, etc. but it's 2 person who want to have sex each other.
 
Good idea on paper, but it won't work in real life.
 
That wont prevent a 30 yr old sex offender from registering himself as a 14 yr old student.

Its a great idea yes. But also it would be very hard for to accomplish it. Because anyone can make a s/n anywhere. Like the library for example. How ya gonna know if its a fake name or not & who's making it?? But a sex offender trying that from their own home would be easy because of the ip address being traced to them. So really should monitor their Internet..But they can also easliy go to someone else's house & make up a s/n that's not registered. So many ups & downs to that bill...A very hard law to pass I think.
 
This is not going to work, nor happen. The Internet is still too wild! If I would do anything illegal, I would NEVER use straightforward Internet. I would get Proxy server somewhere outside the USA, making it harder for any authorities to track my activities.

Sadly, but the truth is illegal activities on the net is MUCH MUCH MUCH bigger than you'd think, or government estimated! Why you all think Terrorist depends on Internet? All because it is much easier to communicate and be completely anonymous!

It all takes one Proxy server outside the United states to hide yourself!

Too bad these politicans never been hacker themselves to understand how difficult it would be. Once they are hacker themselves, they will know this bill is useless!

I have a friend who himself is a sex offender, did he rape someone? No. Did he force someone to have sex? No. Did he promote to have sex? No. Then why is he a sex offender? Many have no idea what's sex offender is. Did you know that if a minor see your private part regardless the circumstances, like locker room or anything, you will be automatically be a sex offender. I find myself appalled by that. But there are separate parts, sex offender has different degree and also the dangerous part is sex predators, these are separate, mommy and daddy, even if your kids saw you naked, you will be a sex offender if someone else caught you. I was astonished. But at the same time in the mixed not to take lightly about particular person.

It´s understandable if they fix the law for severe sex offender (rapist, stalker, prevert, etc.) only but legal age and minor? *sigh*

I know, and news media feed the hype. To me, it makes me nauseated. He said that his lawyer said that the judge will ask you if minor saw your private parts, it's all it matter, if you want to go ahead with the trial to prevent your name, but as the charge is are you guilty for kids saw your prvt part, not what happen, does it expose, if so, you go to prison, so best to go ahead with pre trial to be guilty to prevent to go on a trial to end up in prison. My friend explained to me the whole thing. He was hurting big time and he couldn't handle how he face whereever he goes. It's toooo sad and painful. I agree, those who are rapist, molesters, stalkers should be the one, not just by indecent exposures ( those who have no tendency for sex or not against other's will)

who's "they"? If it's a innocent sex offender, it's beyond the pain. Some of them killed themselves. Whatever the title of sex offender (meaning like indecent exposures), will not give a details of what happen. There are lots of loop holes in the labels. I think the way i see, D A is making all the profits to make more laws to restrict of many other things, if you go to law library, you will be amaze how many there are. It's more of this country as, We The Law than We The People. Even news media edited alot to make it look bad on the person. I have learned alot. To me, its frightening. It just like if you 4 people in the car, you don't do drugs but others do, you will be arrested along with them. Even proven your blood test, no drugs, you are still booked and prison. It is tooo extreme.
