This interview with Paul Rand is interesting: according to him, TSA had no idea who he was at first and he didn't tell them. And in fact, they only learned after the whole pat down incident and let him go without further delay AND even offered to let him skip ahead of others in line. he refused.

This is quite illuminating - TSA did not knowingly detain a congressman. They had no clue who he was for all he showed them was his driver's license and didn't say a word about his political status.

HUH! This changes everything, doesn't it?

I just hope with all the fuss Paul Rand is making over this that it won't just be all talk and no action. That he will actually do something about it.

by your logic - any citizen cannot be arrested for breach of peace until this goes to court. example: if a citizen is punching a person, he shouldn't be arrested unless this goes to court to prove that he was in fact assaulting someone and that he was not "fist-bumping" or similar.

and yes if Congressman was illegally detained, that officer plus officer's supervisor and any parties involved will have to answer for it. And chance is they'll either lose their job or say good bye to their promising career growth because we both know what happens if you piss off a wrong person especially a very privileged one.
 
I have seen several get the names turned around in this thread. Confusing I know because Paul is a common US first name. But, the well know members of this family are the father Ron Paul and his son Rand Paul. The last name in this case is Paul.

The Constitution also protects freedom of speech and assembly, so why not? They might have to contend with some very irate people with full bladders though.

Actually any citizen could be arrested for breach of peace at any time, it doesn't happen because the police know they have little if any chance of succeeding in court and might even get is serious trouble. This is true for may situations. This is why sometimes people are not arrested while a legal review is done by the lawyers to decide if there is a good enough chance that they would prevail in court.

I am willing to concede that the constitution expressly prohibits any delay of the congressman's progress towards Washington, DC. But, without judicial review of the law in regards to this situation, we have no way of knowing if this might be a valid exception. There are different ways the courts might view this action. The courts might even decide that the constitution prohibits any delay, even waiting in a security line to be unconstitutional. My point is, we do not know how the courts would rule on this.

I personally would find it fascinating to see the courts review this case. Take a fairly simple straight forward constitutional law and feed it to the U.S. Supreme Court system.
