George Zimmerman's attorneys push to use Martin's toxicology reports in trial

SANFORD, Fla. -
In a new motion on Tuesday, George Zimmerman’s defense team argues that they believe Trayvon Martin was high on marijuana the night he was killed by George Zimmerman.

Zimmerman’s lawyers say they want to introduce toxicology results from Martin’s autopsy that show THC, a key component of marijuana, in his bloodstream.

The new motion, written by defense lawyer Donald West, says the defense plans to argue that, “it is likely that Trayvon Martin was under the influence of marijuana at the time of his death and that his thinking and judgment were impaired at least to some degree.”

The motion filed on Tuesday argues against a state request last week to prevent the defense from using Martin’s toxicology report at Zimmerman’s trial.

Although the state wants to keep Martin's past out of Zimmerman's second-degree murder trial, the defense appears to be pushing to use Martin's alleged past drug use and to imply that Martin was "under the influence of marijuana at the time of his death and that his thinking and judgment were impaired."

The motion states that Dr. Bruce Goldberger, the toxicologist for the prosecution, said at a deposition that Martin may have used marijuana within a couple of hours of his death or it could have been longer than that depending on whether Martin was a chronic user or occasional user.

"From other evidence in the case, it is known that Trayvon Martin brought marijuana with him from South Florida to use while he was in Sanford and that he used it at least one time after arriving in Sanford prior to his death," West writes in the motion. "Trayvon Martin was suspended from school for possessing a baggie containing marijuana residue and was known to smoke marijuana with his friends."

In a footnote to the line in the motion, the defense says, “This is why Trayvon Martin was in Sanford rather than in school in Miami where he lived.”

The defense also states the toxicology report is necessary in the trial because Zimmerman's non-emergency call to police, he describes Martin as appearing as though he was "on drugs."

In the motion, the defense also argues that the 7-Eleven surveillance video shows Martin “’sways’ at the counter at the counter as if he’s under the influence of some substance.”

West continues that the jury should be allowed to give the evidence of Martin's toxicology report, "whatever it believes it should" and that it is "relevant for the jury to consider when it evaluates Martin's actions that night."

The defense also filed another motion on Tuesday that said the state's audio experts is charging too much for his time for a deposition.

Zimmerman is charged with second-degree murder in Martin's February 2012 death. He has claimed self-defense. The next hearing in Zimmerman's case is slated for May 28.

That is totally irrelevant to the case ! Zimmerman did not know that when he saw the Trayvon. So does this mean anyone high on pot should be looks at like they're up to no good!
 
I never met any pot head that's clearly violent person, I am not buying this crap whether there is THC in blood or not.

I only can buy if they are on PCP, Angel dust, Meth, cocaine, booze, whatever that got white stuff.

O RLY? they wanna go down that way? ok let's see... Zimmerman was on medication for antidepression and something else..... which are known for hallucination, paranoia, etc.

That's pretty funny - marijuana are more relaxation behavior than aggressive behavior. I knew a person who is extremely temper and when he smoked marijuana he looks much more relax - even after we picked on him. But the negative thing about marijuana is impaired judgment.

I agree. I've never known anyone to be violent while under the influence of drugs.

If they do prove that there was marijuana in his system, then I hope the prosecution brings up the fact that marijuana calms down the person instead of making them more violent.

I have seen enough violence from any kind of drug except Rx and Cannabis.

PCP, and Meth is the worst of the worst and I don't think the victim is taking meth or PCP cause I know how it would affect one's appearance.

Yeah the list of side effects is a mile long on the TV ads for this. I never seen anyone get violent while smoking pot , I see them get the munchies .
Any one that being followed at night by a strange man is going to feel threaten and they will not need to be stoned to feel this way.

I am so sick of people that commit a violent crime taking the insanity plea.
There are millions of people that have depression and they're not insane.

My cousin is in jail on burglary charge and he's very addicted to heroin. :(

it won't even reach close to minimum legal requirement for insanity plea. he does not have any history of mental illness or anything at all.

carrying a gun + mental illness? that's a felony. kinda. but it would not bode well for Zimmerman if he chose this route. it would imply that he made a wrong decision to chase him.
 
I haven't heard anything about Zimmerman pleading insanity. Where did that come from?

Defense releases photos, texts of Trayvon Martin | Fox News

I can't find a link yet but there was also a TV mention that there were also emails and texts from Zimmerman to the residents a couple weeks prior to the shooting, that might be included in the trial. The emails were warnings to the residents about a suspicious young black man who had been spotted in the neighborhood.
 
just a possibility.

If so, he will spend rest of his life in psychiatric hospital and have fun to play with other patients - use L hand inspired "gun" at others as play. :aw:
