Texting Sender Liable for Car Accident?

This is just another blame game going on.

No one wants to take responsibility for their own actions. So, they look for something else to blame.

This reminds me of a lawsuit that occured years ago.

A cop was killed by a meth addict.

A woman sued the manufacturer of the cold medicine that was used to make the meth that was used by the addict that killed the cop that was the husband of this woman. :roll:

That is not how the law work , both person are the blame if an accident happen while texting . If someone send a text knowing the person getting it is driving and this cause an accident the person that send it to the driver is partly the blame for the accident . This is almost the same law as a bar owner servicing a person so many drinks that get so drunk then have an accident driving home. The bar owner is held responsible too. Something has to been done as the it's too to stop people from texting while driving. I wish we had this law in my state as I as sick of having to watch out irresponsible people texting and driving at the same time. And they're doing right when kids are getting out of school , a child was hit already while school was getting out and we idiotic people texting and driving right near the school.
 
I humble disagree with your analog, its almost impossible for other side to know whether that person is driving or not. Its STILL drivers who texts while driving is at 100% fault and it is the law here in New York State. If cops sees you text, they give you ticket, and you have a day in court.

Legal teams are going to have to read texts very carefully. You see, if the person said that they are planning to shop for a bike tomorrow, how do you know whether they're driving or not? If they text you that they're on road...we're driving. We're almost at your house. That is where trouble will lie.

I disagree with you . If someone just left your house in their car you KNOW they're driving and if you text that person right after they left your house and they text you back the person sending the text will be held partly at fault I there is an accident. I don't the law has been pass yet.

This is going to be a very difficult law to enforce , it may made some people think twice before sending a text to someone they know is driving at the time. A woman got into my lane while she was texting and this right when school was getting and kids are everywhere. That was so irresponsible of the woman.
 
Thats 1% of the time, other 99% You will not know what others are doing, seriously.... Quick, pick one of your friend from your text list, and send them Text message...NOW! Make sure they don't drive, eh eh? I don't think there is a way for you to actually know at that moment that your friend is driving or not.

Defendant attorney Said to the Judge, "He had a passenger that does text while he is driving for safety purpose". Drama goes on. It will never come up as a evidence.

Anyway, you see, you have no idea if that person is a friend of his doing text for him. Its really IMPOSSIBLE to tell if one text and drive. It is the drivers 100% responsibility not to screw with text. If it rings, fine it CAN WAIT! Just like what Z just said... so easy, so simple.

I often have my wife text for me on my pager while Im driving. How do my friends really know whether Im texting without driving or true business driving?

As you may have seen before, there's a TV commercial saying "Don't text and drive. It can wait." Do you expect another commercial saying "Don't text to a driver. It can wait."? :laugh2:
 
Reminds me of that bartender in Ohio(I think) who was fired because she felt the person had too much to drink and didn't want to serve the person any more drink. Where is the uproar about that bartender?

True. However, many of the cars are driven by drivers and no riders. If no passengers in car, it's very easy to pinpoint blame on driver. How would the person texting the driver know the driver is driving?

I guess in the future, I may have to tell, here is my text. Don't text back if driving. Thanks.

Turn it off. Like you would do while watching a movie at a local theater or sitting in a classroom at college.

I have my phone off more often than on. I never have it on in the car (if I'm driving), at school, at church, at work, at other people's homes, at weddings, at funerals, at restaurants, or at any kind of meetings. In fact, almost never. I just check it frequently for messages.
