The State of Ohio executed a convicted murderer of children who had 30 years to make a case for a retrial, resentencing hearing, or leniency.
You are right. But, we need to prevent this from happening again. In this case it might be justified to hold the prosecutor responsible for failing to disclosing mental or medical information that is relevant to the case. Obviously the defendant was not capable of defending himself.
I'm not a student of the law so I have no idea if the prosecutor has an obligation to disclose this information to the courts or not.
