MANATEE, Fla. -- A 73-year-old Bradenton-area man who crashed his motorized scooter after too many drinks is suing the bar that served him.

The Bradenton Herald reports John Wasko of Manatee filed a lawsuit this week against The Oasis, saying the bar should have stopped giving him drinks. He's seeking more than $15,000 in compensation.

Bar owner Brenda Cays said she's unaware of the lawsuit but that her staff stops serving when necessary. She says she's driven patrons home and paid for taxis for drunk customers.

The suit stems from a January 18th incident. Wasko was riding home on his scooter when he was struck by a vehicle. He blames injuries from the accident on the bar. Bradenton Police cited him for walking in the path of a vehicle.

Exactly what I was thinking. How did the bartender know he was going to drive.

bartender is not supposed to continue serving more drinks to any visibly-drunk person.
 
Yep!....supposed to say..."you've had enuf!...Get ur stinking ol' ass out of my bar"!...So he hops onto his little scooter....and has an accident....

At his age, seems somebody would have been "concerned" at the bar...and called a cab for him. Then again, probably he was a long-time heavy drinker, and could hide his drunkness very well......

Ohh. So why doesn't the guy drink in moderation in the first place? Why make his lack of judgment someone else problem?
 
I wouldn't be so trigger-happy re: faulting the bartender because people come in many packages and probably more often than not, it is difficult for a bartender to make a judgement. Bottom line, irrespective of existing law: PERSONAL RESPONSIBILITY!!

True.....the bartender has no idea what the guy had before he entered or what meds he might be on. Some people can be drunk as a skunk and you can't tell by talking to them

Now if they served him 10 drinks that's another story.

This is why I have a paid driver on nights out. Much cheapier than a DUI....

..if drink and driving is not allowed....then WHY do bars have parking lots?!? wouldva prevent a lot of accidents...
