A man driving a motorized shopping cart shot an Anchorage Walmart assistant manager during a dispute over the man's unrestrained dog on a busy Saturday afternoon inside the Midtown store, police said.

Police arrested the suspect minutes later. Medics rushed the victim, a man shot once in his midsection, to a hospital in stable condition, police said. The store was not shut down, a police sergeant said, and business continued as usual minutes later, with many shoppers unaware a shooting had taken place.

Police later identified the shooter as Daniel Pirtle, 45. The victim, Jason Mahi, 33, was in surgery Saturday afternoon, a police spokeswoman said.

Pirtle, a double amputee with metal, prosthetic legs, came into Walmart with his service dog not on a leash, police Sgt. Cameron Hokenson said.

Mahi is an assistant manager at the store, according to Walmart. He asked the man to leave, police said.

"There was some kind of dispute," Hokenson said. "They were escorting him out of the store and something happened on the way out where the suspect pulled out a weapon and shot the employee."

Army Sgt. Carlos Morales said he, his wife and his kids were in a nearby aisle. His wife played with a hula hoop, then they started walking to where the store displays TVs, Morales said.

"We literally just walked around the corner and heard a gunshot. It just sounded like somebody dropped a big box," Morales said. "You try not to think a shot just went off."

A Walmart employee told Morales someone had been shot, but there was no announcement or direction from Walmart managers about what to do. Morales, who's been on five overseas deployments in his 12-year career, saw a nurse rushing to help Mahi, and decided his military training might help. Morales elevated the wounded man's feet, and the nurse put pressure on the wound, he said.

"He said, 'I can't feel my feet.' He just kept talking about his kids," Morales said. " 'My kids, my son,' that's basically all he was saying. Everyone else was just trying to keep him awake."

They were near the sporting goods section.

An off-duty police sergeant also ran to Mahi, police said.

"He happened to be shopping in there at the time and heard a gunshot, heard some of the employees and also some of the shoppers say somebody had been shot," Hokenson said. "He went and assessed the victim and determined the suspect had left in a motorized wheelchair, a motorized scooter-type thing."

Pirtle piloted the cart through the store toward the front doors, police spokeswoman Anita Shell said. There were no reports the man brandished the gun at anyone, Shell said.

The off-duty sergeant and police officers arriving in about a dozen police cruisers caught Pirtle near the front entrance to the store, Hokenson said. Officers put him in handcuffs and took a handgun from him, said Wayne Toovak, a witness.

"It was a big, long gun," Toovak said.

The officers removed Pirtle's prosthetic legs and put him in the back of a patrol car. They held his light-brown dog, barely more than a pup, in the back of another police cruiser. Pirtle was charged with first-degree assault and fourth-degree weapons misconduct and held at the Anchorage Jail on $50,000 cash-only bail, police said. An officer at the store said she was driving the dog home.

Inside Walmart a short while later, there was almost no sign that a shooting had occurred. A pile of crumpled, yellow police tape sat behind the gun counter in the sporting goods section.

"Sporting goods isn't going to be open for a little while," an employee said.

A store manager declined to comment.

Arkansas-based Walmart spokesman Dan Fogleman said he could not answer many questions about the store's response immediately following the shooting, because he did not have all the details.

"This was a senseless, unprovoked act of violence, and we're deeply disturbed by the actions taken by the suspect toward our associate," Fogleman said. "We remain concerned for our associate and pray for a quick recovery from his injuries."

Morales said it upset him that the store's employees did not do more to warn other shoppers, many of them with children and oblivious to what had happened. Nobody knew if the suspect was still in the store or if he was dangerous, Morales said.

"Some people were frantic. Some people were just shopping, because they didn't know," he said. "We didn't know if it was a live shooter, going crazy shooting up the store. ... You can't just continue checking people out, like everything is normal."

"I've seen a lot of crazy stuff in Anchorage, but this is probably the craziest thing I've ever seen," Morales said. "I'm not understanding it. Who just goes to Walmart and shoots somebody?"

Guess the guy was fed up with discrimination... but seems to me the pup wasn't a service animal? No mentioning of a sevice vest or anything, I think the man was just disturbed.

As former Walmart employee, I know that managers will leave you alone if your service animal has service vest, but in doubt just show a certification, also without leash is red alert.

Now, Pirtle has to serve in the prison if the court find him as guilty - he made a very stupid move.
 
Guessing this man felt sort of "entitled"....and he got into Walmart with a loaded gun....feel he was just a fuse that would have went off any time...he needs to be locked up, double amputee or not....and hope the man that got shot will survive withoput any medical complications...very sad this happened!

If SO, there are other questions I have for them but I'm not going to be 13th juror for now. If there is no video evidence then some people are good at making up stories, that is my main concern, there is always two sides of story.
 
Since by law, he is STILL innocent and are you hoping that innocent person suffers? I would wait until all dust settled then let the Justice do their job.
I hope they don't give him his legs back. Let him suffer without the legs.

Uummm, The manager has a hole in his stomach by the suspect captured. I am sure they have enough evidence to charge him.

I have a problem with Walmart for not going on lockdown. Walmart never cease to amaze me. They resumed business as normal!?? Then again, it's Walmart that we are talking about.

Very possibly yes because Walmart has video camera on ceiling and LEO can request Walmart to review the video.

It may not report on news but video evidence could be used in the court.
 
I am forty miles from where this happened. I almost put something in here about it. Mostly due to my outrage. We have extremely loose concealed carry laws here. When Sarah Palin was in office there was a big effort to try and at least restrict the mentally ill from having concealed carry. The fellow the court case was over was genuinely ill and prone to hallucinations even while buying guns. Which is how the case came about.The NRA got involved as well as the governors office acting like it was a personal mission to make sure that mans gun rights were sacred. Yep he won. The mentally ill can carry here. Thank you NRA.
This man who gunned the assistant manager at Walmart was packing two loaded pistols to go in to pick up a few items. He had a rambuctious part coonhound puppy not on a leash with him while cruising in a crowded store in an electric cart. He has known mental problems. What could possibly go wrong?
It is on video tape and the way the Anchorage Police Department works it is questionable whether we will ever know what it shows. As everywhere the reported news usually has some flaws.
 
I find Daniel Pirtle guilty of attempted murder because it was not self-defense. If he's a legal gun owner, OMG!

I took my hearing dog Finlay to a Walmart in New Hampshire and Finlay had on his working jacket and his leash and collar also had 'hearing dog' written on them and I was still harass about having a service dog in the store. You're wrong , Walmart is horrible about people bring service dogs into their stores.
I never shop there anymore as I hate their attitude about women rights.
The guy was looking for trouble when he brought his dog off it leash into the store . I feel if his dog really is a service dog it should be taken away from him as he is not being a responsible owner. The dog should be given to someone that would really appreciate having it. The guy took no consideration
about what would happen to his dog if shot a person.

Most states CCW laws require you to be eligible to legally own a firearm. If you've been involuntarily committed, are judged mentally incompetent etc then you cannot buy a firearm or get a CCW. States are required to provide this information for nics checks but they don't always but the law is there. NICS is federal and applies to Alaska as well. There is no requirement to get a CCW in Alaska but if he WAS ineligible to own a firearm it really makes no difference.

If someone is "genuinely ill" or "prone to hallucinations" and a danger to society then why are they not involuntarily committed or judged mentally incompetent? If you give the issuing authority the right to arbitrarily decide who is mentally ill then how is that justice?

No, I'm not wrong because Walmart policy allowed animal service because of comply with ADA law - that's FACT.

The determine of your problem is the manager or employee made mistake, not me, you should complain to highest level manager. The harassing on disabled customer with service dog is termination offense and the victim will receive a compensation, also option to sue the company, that's serious matter.

I know some people brought service animal to Walmart without any problems.

Was he legally carrying concealed weapons?

That's the dilemma.

I support the restriction of permits to mentally incompetent people. However, by what criteria will applicants be judged mentally incompetent? That's going to be tough to iron out.

Our state (SC) right now is working on such legislation. Recently, a total wacko woman attempted to shoot school staff in front of the school building. The only reason she didn't succeed was that she didn't know how to properly load her gun. She admitted that she aimed and pulled the trigger multiple times. She had been previously arrested for making threats against President Bush, and judged incompetent. But she was still able to get a gun. :mad:
