Discrimination based on sexual orientation are handled at the state level. That, in no way, implies that it is legal to discriminate at the federal level.

Questions about your spouse are not illegal though.....and pretty necessary in a security background check.....Even TSA people are questioned about their spouse.

There's federal agencies that can discriminate on sexual orientation.

State level and all else below ... Protected.

Even in most Civil Courts - The Court doesn't have to provide you with an interpreter.

But again, I don't expect you to know all this.

And that leads us right back to the question: was the marraige performed in a state that recognizes same sex marraiges? Were they in the same state when this occurred as the state in which they were married?

The first question is important because if it was simply a ceremony that did not lead to legal recognition, then there is no "spouse."

And the second because there is no reciprocity across states.

I don't have access to a current security background form, so I wouldn't know what questions are included. If questions regarding sexual orientation are illegal than I suppose they aren't included.

Again, any questions that aren't completely or truthfully answered will send up a red flag, and will be investigated.

Thanks for your response. So, if one was not asked about one's sexual orientation, it obviously was something that a decision could not be based on. Correct? Nor could one be accused of withholding information.

But it's (clarifying for jillio: being a homo (not derogatory.)) also grounds for termination.
