Some of you challenged me back then that it is not true that since death of Lay, whose found guilty will never be convicted by the court of law. Now here is hard proof that I was correct when it comes to legal and death of a defedant BEFORE the sentence were announced.

Judge tosses conviction of dead Enron founder - Oct. 17, 2006

Conviction almost always throw away when a person dies before the sentence is to be announced. Now that Lay got away and his family is safe from the lawsuits. damn!

I agree with you.

The real problem is, court can NOT sentence a dead person, then what is the validity of the conviction without sentence? That is the real problem. And because there is no sentence, therefore no restitution involved, nothing at all.
But again it is the law that we live in. Sucks? You betcha!

My goodness. it isnt fair!!!!

Er...where is the restitution going to come from? Go after the family (and its wealth)? There is a fine line here. Not something to do lightly unless the family or family members were guilty too. I guess the best thing would be to sieze the "ill gotten" gains and make restitution that way. Whatever one does, make sure the family isn't smeared or lack the basic resources to survive. It isn't fair to them. Unfortunately, they will be "judged" by society at large. Life is never fair is it?

Question is what to do with 43 millions?. I am wondering. I hope that money give back to people's loss thier investment or retirement plans. I guess we will wait see what they process with 43 millions go?.

Good question! More likely the attorney is the one who pocketed the most, second is the court system that also pocketing alot money. Victims usually gets a drop in a bucket. But I could be wrong for all I know.

Ken Lay cheated by dying of heart attack. Damn, he never got to pay the price for his guilt.

Hey DHB,

Why not go into law? I bet you'd find it interesting. You could be a lawyer and we'd all pay you to help us sack everyone else.

Eh? I just enjoy learning new things every day, however I love my 2nd job to death! I have the burning desire to get into permanent position with 2nd job! Helping others get their VP up and running. That is my 2nd job! :)
