I hope so too as soon as possible, because It is supposed to snow later this evening and tomorrow as well. I had to purchase two electric heaters, electricity hot pot to heat up water for showering, also we brought an electrify one ring stove to heat up food. It sucks big time! I am wearing 4 pair of socks, two shirts and two jog pants, same goes for my boys too. If it gets colder tomorrow we are going to stay at a hotel. Christmas is gotta suck for us this year because the money I worked for in Florida was supposed to be their Christmas gifts, after all this had happened looks like they are gotta get a lot less this year. :(

Aww that's sweet Tweetybird. :hug: Don't feel bad, stuff like that can happen, but it happened at the wrong season. I wish it didn't happened when it is cold out, but what can I do? My nose looks like Rudolph too, Maybe Santa would ask me to guide his sleigh. :giggle:

The Dominion gas said it's out of their hands because they only shut it off for safely reasons because of gas odor, there a leaking somewhere in the pipe underground in order get my gas turned back on the Landlord has to hire a private professional certified by state to repair the gas line and then they will come out and turn it on after the job is completed.

I talked to the City of my hometown, and the Mayor's office also and he said that a few people came by the house yesterday to located the lines, and that the Landlord has to get a permit from the city to have the professional certified to dig underground to the gas line pipe to find out where the leaking is located at, then they can do repair It's gotta take a few more days because it's a big job and the City suggest me to stay with a family relative until the job is compete and I told him that the Landlord refused to repair the problem, the Mayor said he doesn't have no choice, the city said if he refused to fixed before this week is over, the landlord will be charge a fine by the City and he would have to appear to court to explain why he refused to repair the gas leaking.

Then finally I talked to my landlord by phone, at the begin he started yelling about how that they have to come out and dig through his brand new drive-way that he had re-done two years ago, and that cost him tons of money and I was like, so you're upset that they have to dig a hole in ur brand new drive-way? I didn't know that it was that important than worried about the gas leaking. Good Grief! He's is such a pain to communicate with. I asked him again are you going to hire someone to repair the gas leaking? He said, "Do I have a freggin choice? Once this all is over, I'm gotta raise your rent up". Oh geesh! :roll:

If you are on lease, he can't raise your rent UNTIL your lease expires. He can't bend your lease agreement and raise your rent. It is against law. If the lease hasn't expires and he writes up a new lease with increased rent, don't sign it.

cheri... move.. that all i got ot say, it not worth it staying with that cheap ass landlord, it just going to make things worse because of his threats to raise your rent, so just move to another one, and ur landlord will be upset cuz he lost his money that he recieve from you.

So all i can suggest you is to move, and more important your kids, dont want them to suffer in cold and stuff. Also if there is a gas leak, should not stayi n there in first place, in case something happens.

I cannot move because I would be breaking my lease, I don't need bad credit on my credit report. Nothing will happen if the gas is leaking the gas is shut off, I already spoke to the Dominion Gas, and he said that there will not be any gas smelling odor, or explosion if that is what you are thinking. I know that it's a bad idea of staying here, I did what I had to do in order to keep us warm. if it gets colder tomorrow we will be leaving the house to stay a hotel. But moving is out of option at this moment until my lease is up which that would be in April, until then I will consider moving somewhere else. ;)

Annyguy, Oh I know, he is just full of talk about rasing my rent up, I won't let it bother me because if he did tried to raise my rent up, He could try but I won't pay because I have a lease and the agreement was 510.00 a month. :thumb:

Good. I just edited my post. Look up and landlord still give you hard time perhaps demanding you to pay more rent money then print that up and show to his face. That'll show him that you are not stupid. ;)

First of all, Your landlord MUST fix your gas pipe first when done satisfty.. then pay your landlord..
As long you can hold your rent $510 bux.
If Landlord angry you and their rights action you.. That's fine.. as long you already conatct w/city hall behalf about tenant act rights... get paper MAKE'EM landlord smell coffee!!!!

Cheri.. thats full of bull!!! about landlord and put you through this hell.. no way.. Ok.. about Salvation Army and Red Cross... umm.. since you still living in city.. how about human resource or ask for first help? You shouldnt spend any money on this but I know you dont have choices.. but be sure save all those recipts.. for later on lawsuit.. to make him pay you.. pain and suffering and trauma.. I bet you 100% that Judge is pissed off to see you like this.. he would say.. why not just go hotel for warm place.. for your kids sake.. Oh Lordy.. Cheri.. try to call any places that you can get help.. through by like community service.. something like that.. I am sure they willing to help you ...

Your landlord cannot raise your rent by the household laws (Tenant rights), you should talk with lawyer against the rent raised while they're repairing in gas lines. My apt cannot allow raise the rent because of section 8 rental in any repairs.. Landlord can send a bill me for repair of wall, it;s pretty cheap repair cost except every yearly inspection to check if they need repair, it's free repair after inspections.

Or you might call your landlord's supervisor, if your home under rental agency.

I kept the boss's phone nbr, that landlord didn't know the boss phone nbr lol.

The money the tenants pay the rent go to court, not to landlord or go to repair, not landlord or reduce the rent. Depend on which tenants pay with rent to lawyer or repair, not Landlord but the proof of repair bills... Landlord can't evit you because you have PROOF with repair bills or whatever.

I'm surprised that Major can't do anything. I would suggest you to check with legal adviser. It cost you nothing.

Why you carried on pay the rent when your landlord refused to fix the problem? I would reduce the rent with the reason in writing.

Phone converstion is out of question because it's no proof that Landlord want to raise your rent. Write a formal letter is the best and also copied for Mayor or Tenant Act Rights for their file to show the proof why you has to reduce your rent due repair...
 
Cheri my dear friend :hug: I know that feeling. Been there and done that. I am begging you to go to City hall and get the help cuz they are the only way to get your landlord fix. I dont care if he treaten you cuz you still have the lease. And continue work with the City Hall. I am sure that your landlord dont want to pay the big fine.

As for your Sister Angel, she over her place to stay while this situation is going on. As you know she care and love you so much. You dont have to be afraid to asked her for help. I can see that she does really care for you. You are so lucky to have her as a sister. :hug: Dont waste any time to stay at your house just get up and go over there and enjoy the warmth of her house while the city hall kicking the landlord's ass.
 
This is NOT as simple as it seems to be. In New York, this can NOT be done and you STILL are responsible to pay the full rent! The rent can NOT be withheld without court order!!! So, the last resort is going to small claim court in order to break the lease. Also, landlord can NOT jack up the rent until the lease is over, and that difference can be easily withheld and landlord can NOT take the law in his hand. If landlord threatens you, call 911 or cop and get them over and you will be surprised that cop will be on the law side. Cops will demand any court papers, if there is none, then cop will REFUSE allow landlord threat tenant and can arrest if persistance exists. Same way tenat can be arrested if threats are present.

The best protection is the court!!! The judge have the final saying.

Do NOT ever think about using Landlord's boss phone number with intention to threating. This can lead to legal liablity that you don't want to. If Landlord loses job because tenant called and threatened the landlord, then the landlord can sue you for three times of wage losses! Ain't worth the risk!!! DO NOT TAKE LAW IN YOUR HAND!!! Let courts and cops deal with it.

FYI withheld the rent money while the lease is in force CAN BACKFIRE in the court! DO NOT attempt this because this will show judge that your trying to take the law in your hands, and can throw you out. Two wrongs can not make it right.
Just pay rent, and file small claim court, also, keep everything in paper trail. This includes any threats from landlord and this can do good damage to landlord.
