More companies are taking action against employees who smoke off-duty, and, in an extreme trend that some call troubling, some are now firing or banning the hiring of workers who light up even on their own time.

The outright bans raise new questions about how far companies can go in regulating workers' behavior when they are off the clock. The crackdown is coming in part as a way to curb soaring health care costs, but critics say companies are violating workers' privacy rights. The zero-tolerance policies are coming as more companies adopt smoke-free workplaces.

· Weyco, a medical benefits provider based in Okemos, Mich., this year banned employees from smoking on their own time. Employees must submit to random tests that detect if someone has smoked. They must also agree to searches of briefcases, purses or other belongings if company officials suspect tobacco or other banned substances have been brought on-site. Those who smoke may be suspended or fired.

About 20 employees have quit smoking under the policy, and a handful were fired after they opted out of the testing. "The main goal is to elevate the health status of our employees," says Gary Climes, chief financial officer.

· At Investors Property Management in Seattle, smokers are not hired. Employees who smoked before the ban was passed about two years ago are not fired; however, they can't get medical insurance through the company.

· Alaska Airlines has a no-smoking policy for employees, and new hires must submit to a urine test to prove they're tobacco-free.

"The debate has gone from where they can smoke to whether they can smoke," says Marshall Tanick, a Minneapolis-based employment lawyer.

Such bans are not legal everywhere: More than 20 states have passed laws that bar companies from discriminating against workers for lifestyle decisions.

There are other ways that companies are taking action against off-duty smoking, such as raising health care premiums for smokers.

Employers say it's about creating a healthy workforce. But it's also a bottom-line issue: Tobacco causes more than 440,000 deaths annually and results in more than $75 billion in direct medical costs a year, according to the Centers for Disease Control and Prevention.

Some smokers' rights groups are vowing legal action.

"These matters will be decided in the courts," says Redmond, Wash.-based Norman Kjono, with Forces, a smokers' rights group. "You're creating a class of unemployable citizens. It won't stand."

And legal experts fear companies will try to control other aspects of employees' off-duty lifestyle, a trend that is already happening. Some companies are firing, suspending or charging higher insurance premiums to workers who are overweight, have high cholesterol or participate in risky activities.

And then someone said they are mad cause the companies are invading their privacy.

But why get mad? why not help the companies save money? Cause
they are too expensive...
Of course the companies are happy that their employees are working
hard for them...

But... the companies provide money for their employees to eat, pay bills, buy house, and allll...
And Employees are whiningggggggggggggggg and get mad
cause they can't smoke.

Why not help the companies save money?

If you own a business, would you want your employees to stop smoking or just hired nonsmokers,,, so that it can help lower your insurance premium?
 
i am against smoking.
i HATE smokers and i dont really like to hang out with peers who smoke.

but realistically, the company has no right to control the employee's life. the employee can do whatever they want at home but must do as the company says on company time.

miss p.....the company gets its money from the employers, if it weren't for the employers, the companies would make no money at all. the employee's provide money for the company boss's to eat, pay bills, provide house, and allllll. so your claim makes no point at all.

if they are allowed to do this...next thing they will say is your not allowed to eat candy...then they will say no sugar allowed....and then they will take control of your life. that a big NO! this is america, im free to do wahtever i want.

and plus...the employee's are the ones who pay for the insurance. its deducted from the paychecks.
 
well to me, cigarettes are sort of like marijuana...
but it is legal...
and if everyone ban cigerettes, then smokers just have to quit,
and nobody will miss it.

candy? then the companies will go too far, we will definitely
stand up to that...

cigerettes will be forgotten.

the companies will do it... anyway...
because we allowed government to ban smoking inside buildings, on airplanes,
and stuff... and now... apartments have the right to...
and Hotels will be next... and
now workers can't smoke...
Then oh welll....

We will have a smoke free country... :|
 
I'm a non-smoker, but I have friends and aquaintences who smoke, and here's how I see it. A person has the right to smoke if they so choose, but when it comes to public places, I believe the employer has the right to restrict when and where the employee is going to smoke. We are coming to a point where smokers will probably only be allowed to smoke in their homes, and that might be a good thing?

To be honest, I really don't know. When you start talking about things like this, the idea of rights has to be brought up. A smoker has the right to light up if they choose to do so, but a non smoker also has the right to breathe clean air, too. So, I do believe it's a balancing act between competing rights.
 
Would you hire a nonsmoking and slim body person

Or an overweight smoker to cut your grass?



Who will get the job done quicker?

If they charge you $20 an hour?


If you have to see from the boss's point of view.

I know you would hire that nonsmoking slim dude....
would that be discrimination?
 
I am against smoker even though I am EX-Smoker! In reality companies are trying to control the OUT-OF-CONTROL insurance premium cost, plus absentism due to illness that has possible direct related with cigarettees! Some companies provide life insurance to employees, however when employees smokes, the life insurance premium triples. So, this leaves employer with limited choices. Most smokers don't realize the cost consequences related to cancer sticks. So, in effect... SHOULD smoker have the rights to be medically treated (Cancer treatment, and other cigarettes related illness) from smoking consequences AT THE EXPENSE of company's insurance? Problem here is that on other hand, company, by law can NOT offer some group benefits and deny others benefits. So, companies does not have much choices.

I honestly hope to see someday these cancer-stick manufacturers going OUT OF BUSINESS permenantly, so that I can breathe better.

Don't smokers get it? Tobacco companies are fraud companies.

Long ago... people were selling you these bad poison to you....
and have some goodlooking people and actors to brainwash you to buy their cigarettes... in commercial. and
they put nicotines in cigarettes, so you can continue to buy them and get hook on them...
Nicotines do not help you relax... it is a lie...
It is just a straw loaded with horrible chemical in it...
and you just suck it up...
So all the myth they told yoou.... and you believe it...
and you use it...
It is just like those fake fake placebo pills,, and you took them cause you thought those make you feel better, but that is all mentality.... all in your head....
So Smokers should dump those ciggys...
it isn't worth protesting and get upset with corporations and stuff...

I rather to go non-smoking area, example: train, restaurant, plane etc.

I don't like to sit in the restaurant in smoking area because it affect my eyes. I hate it.

The smoking are ban in work place where I work. If people want smoke then go outside or at smoking area in cantine.

I has no problems with smokers who respect non-smokers.
 
Respecting is not the problem. The real problem is, when smoker gets sick from cancer sticks. Who should fork the medical expenses for these smoker who refused to quit long time ago? Should you (Non-smoker) pay higher health premium to support these sick smoker? Think about it.

Yes, I know and agree with you.

What should I do if they don't want to give their smoking habits up? Should I judge them for that?

True. My hubby owns his business, and he would not hire smokers. He has a small business and can't afford higher insurance costs. Also, his customers don't want "smoky" smelling workers in their homes. Same for my daughter and son-in-law's business. All workers must look and smell clean.

I know that I don't like "smelly" workers to come into my house. Ugh!

I can smell smokers even at the college where I work, especially after they have their "break". They come back into the classroom, and they stink! So I understand why people don't like to work with smokers.
 
Yea, the true objective of business is what? Make money, not losing money. If one already have money, they probably won't run business, right? Money don't grow on trees, if there is one we won't be needing business anyway.

I think Smokers take longer breaks than nonsmokers...

It took almost a whole month for the people my mom
hired to put sidings on the house.....

They would smoke and smoke and smoke...
and our front and back yards look like ashtray..
all of those ciggy butts... yuck...
and they didn't really do a neat job...

We had 4 men out there... and only one worked...

the other 3 men were just smoking and watching... :smoking: :smoking: :smoking:
I know the two are assistants and one is a supervisor...
Supervising for what?

But dang... we need more than one to put the siding on the
house... ugh... stop smoking and work!!!

I feel sorry for that person who was working by himself,, and
it was cold outside... 30 degrees....
 
im been smoking since i was 18 years old but im been carefully my surgery and my parents found out i was smoking!

i never been fired from work no! but i been get smoking break only!

so what will happen if your boss use this policy
and say you can't smoke, will you quit smoking?
Or find other job?

Finding a smoker that respects the wishes of non-smoking roommates or landlords is a very rare occurence.
