LOS ANGELES -- The hospital where Nadya Suleman gave birth to her famous octuplets has been fined $187,500 for failing to protect their medical privacy, according to California health officials.

It's the second time Kaiser Permanente's Bellflower hospital was fined under new legislation designed to protect patients' medical records.

The hospital was fined $250,000 in May for failing to keep employees from snooping in the Suleman's medical records.

The fine was the first penalty imposed and largest allowed under a new state law enacted last year after the widely publicized violations of privacy at UCLA Medical Center involving Farrah Fawcett, Britney Spears, California First Lady Maria Shriver and other celebrities.

"We are very concerned with violations of patient confidentiality and their potential harm to the residents of California," said Dr. Mark Horton, director of the California Department of Public Health. "Medical privacy is a fundamental right and a critical component of quality medical care in California.

Kaiser Permanente spokesman Jim Anderson says an internal investigation found that eight Bellflower Medical Center employees improperly accessed four of the babies' records during the week after they were born on Jan. 26.

Four of those eight employees resigned in February for looking at Suleman's medical files, the hospital said. One more was fired, two employees resigned, and another was disciplined for looking at the babies' records, Anderson said.

Kaiser officials said a total of 27 people looked at either the mother's or the babies' records without authorization: Altogether, two were fired, nine were disciplined, and 16 resigned.

"We have no reason to believe that anyone gave this information to anyone else or the media," Anderson said. "The state followed up on our report and checked that we reported accurately."

Kaiser reported the violations connected to Suleman to the state in February and the violations connected to the four babies in late April. The public health officials issued their own report and announced the fines Thursday.

That would depend on who she picks and choose to be her attorney. It would also depend on how much she would ask for.

Well, before everyone goes ballistic about it, let me say I HOPE she does sue! Not because she needs the money or who she is, but because snooping in someone's medical records is wrong! A message needs to be sent that strong penalties will result if you obtain someone's medical info without their permission and try to sell it!

That's true and employers have been known to violate employee's medical privacy by asking personal medical questions when it is against the law to do so. Wal-Mart was one of them and I used to work for them.

They had to post their violations on top of the time clock. Eventually it got moved little by little until it got completely covered up. I called EEOC about that and they got fined big time for that.

All these fines that the hospital got is basically chicken feed. They need to be in consist of millions, like maybe 100 mill per fine? That'll wake up the bastards.

Another reason why Wal-Mart does not want to unionize. They want to be able to get away with anything they want to.

As for medical violations - they should be posted for everyone to see. Knowing that the general public is going to find out you broke the law is going to make one more aware that they need to follow the law.

This is about respecting one's privacy.

These major hospitals should be investing in software that allows the patient file to be retrieved electronically and only the ATTENDING DOCTOR AND NURSES assigned to that patient should be allowed to view the records. If you are not needed in the involvement of the treatment, then you don't need to know about it. That simple.

Employers should NEVER ask about one's medical condition. If it may cause issues on the job, it is entirely up to the employee to bring it up, however if the employee does not show documentation of notifying his employer of a medical condition, his employer is not required to pay for any injuries occurring on the job because of the condition. Meaning it is up to the employee's discretion whether or not his/her boss should know of a medical condition. It allows for communication while still respecting privacy.

Over 10 or 11 years ago when I was still healthy and able to work, I applied for a job at Walmart. After several phone calls, I was then told by the Walmart supervisor that they cannot hire me because I am deaf ("we can not hire you because you can not hear" is what they said). I had no words...just hung up on them - just too shocked and insulted. I was between homes and was living with a friend's parents at the time (I had just gotten out of an abusive relationship and my friend's parents were so nice enough that they would not allow me to go back to that situation and made me stay with them for my safety). Eventually, I got another job somewhere else. But ever since, I would never ever work for Walmart, ever. I won't work at places that discriminate against the Deaf or disabled people. I know it is a bit off-topic but it is related to Walmart so I thought I should post this.

i would agree!! i did apply at walmart and they wont hires because of deaf!! that totally discrimination!! for against deaf worker..

my ex-boyfriend also work at walmart but im not sure how long he been work there and he never have problem with communication but my ex-boyfriend is deaf.

Tell that to me Walmart still hired me even though Im soo damn stone deaf. Guess it was my 13 years of experience at my old employer, Goody's Family Clothing. It aint just becasue of being deaf, but they are INTERESTED in how good you have worked. Work experience HELPS a lot.

Yeah, but they never even interviewed me or anything. I put in an application, made several follow-up calls to make sure they recieved the application, asked about an interview, was given the runaround between several managers til I got to a supervisor and that was when I was told they could not hire me due to my hearing loss. That's discrimination right there. They never asked about my working history or anything like that...as soon as they realized I was deaf (I used relay to call and speak to them) they told me that they could not hire me due to my hearing loss. My jaw dropped to the floor, I suggested several positions that I would be able to work in, was refused, and I just was like uh.....ok.... *hangs up phone*. I had desperately needed this job because I was in between apartment due to getting out of an abusive relationship and I had moved about 60 miles away and I had been let go at my last job (laid off) so I needed a new job NOW. I didn't want to spend a long time at my friends' parents house in fear that they would think I was a freeloader. So this was pretty frustrating. This was in 1999, I think.

i did apply goodys but they wont hired because of deaf!! that lame no excuse!!
