A decorated disabled Iraqi War veteran is slapping McDonald's with a $10 million lawsuit -- claiming he was pummeled by employees at a Brooklyn franchise when he tried to bring his service dog into the restaurant.

Retired Army Capt. Luis Montalvan, 36, charges that workers at the eatery on 52nd Street and Fifth Avenue in Sunset Park pounded him with plastic garbage can lids, leaving him with neck and back injuries.

Montalvan, who suffers from post-traumatic stress disorder and traumatic brain injury, uses his golden retriever, Tuesday, to keep him calm.

In December, the ex-soldier who walks with a cane, went to the fast-food restaurant with his dog, and the workers allegedly began berating him.

"Employees started yelling, 'No dogs!' and 'Get out!' " he told The Post.

An angered Montalvan, who earned two Bronze Stars, wrote a complaint letter to the corporation, resulting in stickers being placed on the restaurant's doors stating service dogs were allowed.

But when he went back a month later, he was tossed out.

Finally, on Jan. 30, he returned one last time to take photos of the sticker when two men wearing McDonald's uniforms approached him carrying plastic garbage can lids, he claims.

The men allegedly beat him for two minutes.

The Sunset Park McDonald's management had no comment.

This really pisses me off how a blind man gets beaten up all because he brought in a service dog inside the restaurant. Especially when a man lost his sight while serving for our country.

I hope he wins the lawsuit and these animals who beat him end up in the PMITA prison!

Lost his sight? I don't read that in the post...he suffers from brain damage and PST...Still, what those McDonald's workers did was horrible!! I hope he gets millions of $$$$$ for this.

Some reports says he's blind while others omit that information. It wasn't all clear, my bad if any misunderstanding involved from these reports.

Nonetheless, what the employees did was wrong.

:mad2: as an McDonald's employer in Australia - anything that is the law must be obeyed - what the fuck was these employees doing? They must be fired and charged with the assult of a blind man.

That's pretty awful.. I wonder if the dog was in a service vest if it was for PTSD instead of blindness?

F*** stupid idiots! The poor man!

*my apologies for using a bad word..just a strong reaction to the story..hope nobody was offended*

Ugh, that's awful!

If any customer tried to bring a dog in, it's not permissible for employees to physically assault people. To assault a wounded war veteran with a service dog is especially reprehensible. He should have filed criminal charges in addition to the civil charges.

Interesting...I guess they failed to see whats out there in the real world where there are some blind people having dogs as not for pets, but as for their guards.

Extremely stupid to beat a helpless blind man who was a solider for our country with a guard dog...and why a golden reciever? It should be a pit bull so the pit bull would go tear the employeers' limbs apart.

They are a bunch of cowards so...hope they served a very long jail time and pay him for the damages he've got on him.

To be honest, I find that extremely hard to believe. If it's true, I am extremely disgusted with their lack of humanity.

Oooooh stupid ignorant kids! Welcome to the real world, it's not run by their own clique preferences since they have a public obligation to allow that service dog in! If the management of this restaurant is equally ignorant, the McD's corporation as a whole is DEFINITELY liable for the actions of its employees!

They said the same thing when they found out Hitler gassed human beings.

The crux of human nature, especially in these days, human beings seems to be getting meaner and bad (and stupid) at each passing generation. "Respect" is hardly in people's vocabulary, if it is, the definition of it is different from what I knew of the definition.

I use a guide dog myself (Heartsong pictured) due to partial blindness, if I were in that situation, I'd be "madder than a Baptist in a brothel" - then ask questions later. Luckily, I haven't experienced that sort of thing, but I'm very well aware of personal opinions about service dogs. Even my eye doc commented that Heartsong is cleaner than alot of his patients!

there's no word to describe my wrath. Maybe I should pay a visit to this place since this occurred in my backyard. :mad2:

Thanks for the link. That's pretty darn detailed right there. Oh man, the nerve of these people!

There's no way these people can win against the Vet's lawsuit who diligently served our country for 17 years. Thank you sir, for serving our country and I'm so sorry there's some assholes out there that doesn't appreciate it one damn bit.

I'm bit more upset that bystanders did not help out.
