Officer Robert Miller, Suspended For Leaving K-9 Partner In Hot Car, Leading To Dog's Death

An officer who left his K-9 partner in a hot car, leading to his death, now faces a 60-day suspension.

Police Chief Larry McNeil of the Bennettsville, South Carolina police department told Carolina Live the officer left Tank, a black Labrador Retriever, in a car with the engine off and the windows rolled up on Monday.

The K-9 officer was taken to a veterinarian, but died Tuesday of heat stroke.

Officer Robert Miller, Tank's partner who was in the K-9 unit for nine years, will face a 60 day unpaid suspension for the death of Tank, SC Now reported.

In addition to his suspension, Officer Miller will be placed on probation for 90 days, and is permanently restricted from being in the K-9 officer program, according to WBTW.

The department held a funeral for the officer, who was buried in a small casket.

Chief McNeill gave a eulogy and said Tank's death has been "difficult and heart-wrenching" for the department.

"This untimely death of Tank is one that's going to stay with the department. He won't be forgotten."

Some in the community are calling for the officer to be fired and even charged with Animal Neglect. Officer Miller has not been charged with a crime.

When asked by Carolina Live why an outside agency was not brought in to investigate the death, Chief McNeil said he didn't call in the State Law Enforcement Division because it was a personal matter.

Tank was four years old and worked with the department for three years, specializing in explosives detection and tracking.

I don't get it. why isn't he fired from the force? the court has ruled that police dog and police horse are legally recognized as a police officer therefore.... this officer's negligent action has led to a fellow officer's death.

Just fire him...suspension and still work after 60 days? That isn't really a fair decision.

I agree. I guess they consider a dog not equal to humans so there's less punishment unfortunately.

If that the care he give his dog then it dont look good how he treat a person.Career review required

at least he won't be working with dog anymore.

What on earth was that guy thinking when he did that? Leaving a dog in a car is so stupid!

I don't understand why he wasn't criminally charged for animal cruelty or negligence.

Yes.

Abuse that cause death to human - felony

Abuse that cause death to dog - misdemeanor

Slow cooking a live animal is one of the most disturbing things i can think of. I only hope he left for an emergency and not to go get coffee or something. I know around here the k9 units are required to leave the car running while the dog is inside. Not to mention that trained police dogs usually cost around $20k

I see it all the time. I always call animal control. They can't legally do anything where i am unless the dog is visibly in distress but they will check the dog later to make sure it isn't in trouble.

and still working there? We get fired from the job for little things, he didn't get fired from the job from a dead dog.

my guess? he'll do a desk job. filing cabinet probably.

Does he give a reason as to why and how this happened? Poor dog, I bet he would have done anything to protect the officer. Sad, really, really sad.

I'm still searching for details.

So far:

"The chief said the dog, named Tank, died Monday when he was left in a patrol car with no water and the windows up as Miller went into the department to do some paperwork.

McNeil said Miller did not mean to stay as long as he did and immediately took the dog to a vet when he realized Tank was in trouble."
