NY passes 1st US gun control bill since massacre

NRA: NY Gun Law 'Draconian'

The National Rifle Association issued a statement in response to the newly-signed New York law banning assault weapons and requiring background checks:


"The National Rifle Association and our New York members are outraged at the draconian gun control bill that was rushed through the process late Monday evening.

"Governor Andrew Cuomo and the New York State Legislature orchestrated a secretive end-run around the legislative and democratic process and passed sweeping anti-gun measures with no committee hearings and no public input.

"Hammered out in a backroom in Albany, S. 2230 was quickly drafted and released 20 minutes prior to the Senate vote. It passed as the clock ticked toward midnight.

"This legislation lowers New York's arbitrary magazine capacity limit from ten rounds to seven. It also greatly expands the state's existing ban on commonly owned semi-automatic firearms, and will require New York gun owners to undergo background checks on ammunition purchases.

"These gun control schemes have failed in the past and will have no impact on public safety and crime. Sadly, the New York Legislature gave no consideration to that reality. While lawmakers could have taken a step toward strengthening mental health reporting and focusing on criminals, they opted for trampling the rights of law-abiding gun owners in New York, and they did it under a veil of secrecy in the dark of night.

"The legislature caved to the political demands of a Governor and helped fuel his personal political aspirations. New York lawmakers have ignored and excluded gun owners throughout this legislative process, but the NRA and our New York members remain committed to having a meaningful conversation about protecting our children and will speak frankly about the lawmakers who have failed to do so.

actually under this new law... it would be illegal to have a possession of high capacity magazine. same thing with NJ. so if you relocate to somewhere... buy a gun w/ high-capacity magazine... and then move back in... well - you'd have to sell it before you move back in or you could get in deep trouble.

Uh no -- its a max of seven bullets in a 10 round mag or high capacity mag. if you get caught with more then 7 - another charge added. Its just one of those weird laws passed for no real reason except to shutup a certain group fighting for a gun control but at the same time not "pissing off" the gun lobby.
 
I just can't believe that NRA and any one of you, pro-gun supporters go nuts over NY gun control law. The law doesn't forbid NYers to have a gun except those kinds and requires a background check when they buy too fucking many bullets. Don't like the new law in NY? Too fucking bad, crying babies! I'd love to tell you that it will disappoint alot of you when time comes.
 
I do not own a gun. I am not interested in owning a gun. I also feel that we have an out-of-control problem. That being said... I post this NOT for advocacy but it's an interesting read from a Russian perspective. It really sends a strong message for gun rights.

It is a strong message about the purpose of the 2nd Amendment from a citizen in a country that has lived with government tyranny for almost a century.

It blows my mind that people are naive enough to believe that it cannot happen in the US. Just look around at the massive amounts of regulation that has on-going expansion of powers. Who do you think wields that power? People in position to do so. They do not restrain themselves, but rather continue to seek even more expansion of that power.

From local HOAs and school boards, up to city council, state legislators, and the feds, the message is very clear: people in power want more power and they are not afraid to use it.

If we give up our right to defend ourselves, and even worse, give away the right to rebel against tyranny, and we certainly secure a future for our children that will not be one that enjoys liberty and freedom, but rather a future that is bleak totalitarianism from government control and corruption.

Theodore Haas was a former prisoner of the Dachau concentration camp. This interview was from 1990, I believe. The pieces that I have not quoted are well worth reading as well.

A.) Many, many times. Before Adolph Hitler came to power, there was a black market in firearms, but the German people had been so conditioned to be law abiding, that they would never consider buying an unregistered gun. The German people really believed that only hoodlums own such guns. What fools we were. It truly frightens me to see how the government, media, and some police groups in America are pushing for the same mindset. In my opinion, the people of America had better start asking and demanding answers to some hard questions about firearms ownership, especially if the government does not trust me to own firearms, why or how can the people be expected to trust the government?

There is no doubt in my mind that millions of lives could have been saved if the people were not "brainwashed" about gun ownership and had been well armed. Hitler’s thugs and goons were not very brave when confronted by a gun. Gun haters always want to forget the Warsaw Ghetto uprising, which is a perfect example of how a ragtag, half starved group of Jews took up 10 handguns and made asses out of the Nazis.

I wonder how they intend to enforce this law. :hmm: Other than regulating the sales, who is going to check how many bullets you put into your magazine?

True Patriot protects the constitution of the United States, this includes 2nd Amendment.

I am deeply disturbed that our government is eroding our US constitution.

Herein lies the problem and it has happened here where I live. Some one usually a guy- myself included will lose patience with some extreme bullshit that our increasing bearocratic nightmare is bringing about. He will start to yell maybe wave his arms, red in the face, some one usually a woman, will call in the protectors, usually guys and they will take the guy down with mace and physical force and in the process kill him.
In the case of that guy he was from out of town living in a rural area, he did not have the developed coping skills of the city person -an innocent trip to the big city shopping ended his life. As a grim aside his dog was out in his truck waiting. The city impounded his truck-the dogs owner is now at the morgue- the dog goes to the pound and is euthanized three days later. Which is about when his friends back out in the country are saying hey where is Richie he was supposed to be back today. Poor Richie and his dog.

As things become more crazy with rules sane people will have lapses in temper- they will be quickly labelled and the way things are now- it will be a label they will carry for life.
Some of us are way more excitable people than others. We have low tolerances for bs. Sometimes it can be the most innocent of transactions but the people involved are so mismatched that it becomes trouble. The one behind the desk who may have actually caused the trouble gets off completely. The other side of the desk? They are fucked.
Labelling in a society that retains all labels and then controls that heed labels regardless of how they came about. This is big trouble.

I can't believe how naive NYS government is! All of these mass shooting shooters obtained their guns illegally, how would new law going to prevent that?

That new law will NOT stop these mass shooting, whats more I could decide relocate outside of NYS and buy guns then move back in, how would that law prevent me? Nah!

That's your opinion and don't expect too much about what court will saying.

NY doesn't have gun rights in the state constitution, so sue in state court will be hard for sure, so federal court is only option.
 
US constitution applies to all states and territories, so NY is NOT immune from US constitution, including 2nd amendment.

US Supreme Court doesn't give you everything whatever you want.

I will be not surprised if US Supreme Court support NY gun law as constitutional.
