The State of Ohio executed a convicted murderer of children who had 30 years to make a case for a retrial, resentencing hearing, or leniency.

You are right. But, we need to prevent this from happening again. In this case it might be justified to hold the prosecutor responsible for failing to disclosing mental or medical information that is relevant to the case. Obviously the defendant was not capable of defending himself.

I'm not a student of the law so I have no idea if the prosecutor has an obligation to disclose this information to the courts or not.

Yes, they do have that legal obligation.

The prosecutor turned the information over finally...in time for Kasich to commute the sentence. He refused. That is the point. Evidence obviously has no bearing on justice.

What makes this guy different from a serial killer that is mentally ill due to mental illness or defect?

Like I told you yesterday, thousands upon thousands of books have been written detailing the differences between a serial killer and someone like this man. AD hardly leaves room for the detailed and complicated discussion of the topic.

I will reduce it to this: disturbed and diagnosable, usually with an Axis II disorder, serial killers are not psychotic. They are not out of touch with reality.

This man was not a serial killer. He was diagnosed, and consistently exhibited symptoms of psychosis. He had 3 Axis I disorders. He was out of touch with reality.

A psychotic disorder carries specific criteria that other mental illness does not have. Likewise, there is a difference between Axis I disorders and Axis II disorders.

I really don't put a lot of credibility in a student paper and "how stuff works" when it comes to discussion of the complicated impact of various forms of mental illness on behavior.

What, there isn't a penalty for waiting? This information should have been available from the very beginning (or at least as early as it was known). I get frustrated when there are laws, rules, and procedures already in place but are not followed.

I can imagine an international human rights tribunal could try the prosecutor. I doubt the US would allow such a thing to happen though.

Like I said before - it's very crystal clear to me. If you have a mind of 10 years old and you've killed/raped women or children... you should not be executed because it's against our moral belief.

If you raped and killed women or children because God or some voice commanded you... you should not be executed.

If you have a sick twisted mind who gets off on raping and killing women or children... you should be executed. Sure you may be mentally illed because no sane person would do this heinous crime but it's not on the same level as those with mental retardation/illness.

Psychopath/Sociopath/Serial killers are typically fully-functional people with functioning cognitive skills... that's why they are very dangerous and manipulative. They know right from wrong but they just simply don't care.

I'm sorry, Babyblue, but you are very incorrect in your statement that mental illness is mental illness. There is a great deal of difference in the disorders that can be classified as mental illness. You cannot compare a psychotic illness to a personality disorder in the impact that it has on the individual.

And again, Andrea Yates knew in advance that she was going to kill her children. Yet you excuse her actions due to her psychosis. Brooks suffered the same type of psychosis. Maybe even to a greater degree.

Brooks was declared dead at 2:04 p.m., after about 15 minutes of the chemicals flowing. He had no final words.

At 66, Brooks was the 46th, and oldest, Ohioan to be executed since 1999.

Brooks lived nearly 30 years longer than the three sons he murdered in their beds in their East Cleveland home. His victims included Reginald Jr., 17, and Vaughn, 15, and Niarchos, 11.

His execution was delayed from 10 this morning while first a federal judge in Cleveland and then the 6th U.S. Circuit Court of Appeals ruled on his mental competency. Brooks’ attorneys decided not to file another attempt with the U.S. Supreme Court, which had rejected an earlier appeal.
 
I have read statements from his attorneys.

But you are correct. What difference does it make? The State of Ohio illegally executed a mentally ill inmate.

A Federal judge and Federal Appeals court disagree with you
