LAKELAND, Fla. - Niko is your average, hyper, two-year-old. So his mother, Jill Van Heest, didn't suspect anything was wrong with him when he started acting up during dinner at Olive Garden along U.S. Highway 98 in Lakeland a couple weeks ago.

"I kinda started to tell him, "Well you're going to get time out. You can't be loud, we're at a restaurant," and trying to tell him how a good two-year-old should act," said Van Heest.

Van Heest said Niko only grew more restless, began climbing on the furniture, and getting louder. "I couldn't discipline him because he wasn't acting out, he was drunk," said Van Heest.

Jill said she realized why her son was behaving the way he was after her waiter and the restaurant manager came to the table and dropped a bombshell. She said they told her instead of orange juice, they poured tropical sangria, which contains white wine, into Niko's cup.

The anxious mother rushed Niko to Lakeland Regional Medical Center, where the toddler was examined. Van Heest said her son was traumatized from being poked and prodded. She said, "It took them a while to get a blood draw from him and it took them a while to get an IV in his tiny hand."

To add insult to injury, the pregnant mom said she was horrified, because she had to explain how her toddler ingested alcohol.

Van Heest and her husband own a Turkish restaurant in downtown Lakeland, and she said they work hard to get things right in their restaurant and there is just no excuse for what happened at Olive Garden on March 31.

"How disorganized can your bar be that you serve something with alcohol to a child in a cup -- with a lid nonetheless -- and not recognize it for half an hour?" she asked.

In a statement to the press, Olive Garden took responsibility for the accident. They said they take the business of serving alcohol very seriously and are relieved the child was not hurt. They also said: "This was an extremely regrettable accident caused by the failure of an employee to follow our strict operating procedures. We have absolutely no tolerance for failure to follow our operating procedures and we took swift, appropriate action to deal with this situation.

Jill Van Heest has hired an attorney, and plans to sue.

Entire statement from Rich Jeffers, spokesperson for Olive Garden:

We take the responsibility that comes with serving alcohol seriously. This was an extremely regrettable accident caused by the failure of an employee to follow our strict operating procedures. We take this situation very seriously, and we are especially grateful that the child involved was not seriously harmed. We have absolutely no tolerance for failure to follow our operating procedures and we took swift, appropriate action to deal with this situation. We are also taking immediate steps to reinforce our standards.



We offer our sincerest apologies to the family of the child, and to all of our guests, whose trust we work so hard to earn. We recognize that trust has been jeopardized by this isolated event, and we are focused on ensuring our guests experience the high standards of service that they’ve come to expect from us.

In most restaurants that sell alcohol here - they will not serve you alcohol unless you physically go to the bar and order it from the bartender. They do not allow anyone under 21 in the bar area. This may become standard in these restaurants nationwide to prevent screwups like this.

In here, most restaurants serve alcohol beverage that waitress to give to customers on request, also proof of ID is required too.

However, in Utah, bartenders cannot serve alcohol to customers so waitress have do it for them due to strict law.
 
In these 'private' clubs - they can sell alcoholic beverages but the customer is required to order a full meal with it.

I think they should have the alcoholic beverages made in a completely different area of the restaurant than the other drinks to prevent screw-ups. Also a bartender can lose his license for serving to minors and face prison time in some states.

If only separated container that what Applebee is doing right now, that's fine with me but no way to have separated room for customers who want drink alcohol and others don't want drink.

Simply dreadful!

Seems like there's shoddy management revolving alcohol in these restaurants.
 
In 5 years ago, we ate at Red Lobsters and my sister want punch juice without having alcohol in it so she got punch with alcohol in it and she said it taste like odd then waitress have to change the drink, also she was 14 years old at time too.

But there is still a vast difference between a child's container and a Margarita container!!! Applebee's shouldn't have to use different containers to begin with but evidently it happened. If bartenders and regular servers are that blind/stupid then they need to be in completely different parts of the restaurant and use separate equipment to prevent this from EVER happening. A server can pour a child's juice into a child container. A bartender is required to mix and serve a Margarita to the public.

Sometime, I think that parent should taste the child's drink at first to see if it has alcohol in it or not before give to their child.

To public? only restaurant with bars so any restaurants without bars, you won't know about how they are making.

Any restaurant that serves alcohol has a bar - I've noticed that in a lot of the restaurants I've been to. ;)

In here, there are some restaurants that serve alcohol has no bars, especially local BBQ in our city.

If customers sit down on regular table so they won't see bartender to mix the alcohol in bar area and waitress have to carry for customers.

If you don't want see happen like that then taste child's drink at first before give to them.

I am beginning to think this varies by State as each state has their own rules regarding serving alcohol to customers.
 
Yes, it is state and local laws.

Of course, some counties are dry, especially in southern states and who made decision to became dry is county, also sometime, cities can go to wet since other part of county isn't.
