A 16-year-old Sydney girl will reportedly become the first NSW child to try to legally divorce her mother after a childhood of abuse.

A solicitor acting for the girl, identified only as Kaye, said papers were being drawn up on the grounds of an "irreconcilable breakdown in the relationship", The Daily Telegraph newspaper reported.

The action will be lodged in the Federal Magistrates Court within a month.

Kaye claims that at the age of 10 her mother gave her to family friend in the Hunter Valley who sexually abused her.

After receiving a small sum of money, her mother continued to sell her, forcing her daughter to go with a number of men, including one who abused her up to 60 times over two years.

Kaye said she was forced to divorce her mother after the system failed her.

"I want it made known what she did to me," she told the Telegraph.

"She's out there scot-free and I'm just sick and tired of the hurt. I want justice."

Despite reporting her plight to police, the Child Protection Enforcement Agency and Department of Community Services in October 2002, no-one was arrested due to insufficient evidence.

I wish it was possible to divorce kids from parents when the parents wanted it due to abuse of trust and emotional back stabbing.

Tsk. Crap like this makes me physically and emotionally ILL. Not the divorce part, of course, I think that's kind of cool. :) But then again, you know, my mother's no piece of cake. So this looks pretty cool...LOL...but ah, her reasons for doing what she did are legit in my book!

That's the problem these days. The government rarely tries hard enough for evidence. They usually go for the "walk in and see nothing" evidence thing. They walk in, look around, see nothing, so they leave. I had a roommate who had a similar problem with his ex-girlfriend. She would give him a hard time with seeing his kids but made him pay child support. The kids' grandmother saw how the ex-girlfriend's house was and told him about it. No real beds (matresses were on floor), no oven, no bedrooms, etc. He tried reporting her, but they told him that they can't do anything unless he can prove it himself. Jeez! After finally getting a good-paying job, he finally got a huge tax return. However, support services took his whole refund check and gave it to his ex-girlfriend as part of the child support plan. As soon as she got the big hefty check, she dumped the kids by giving them back to him permanently and disappeared. Damn that bitch.

Whoa! What the hell ! I couldn't do that to my kids, if I were in her shoes. If, I got the big hefty check like she got, then I would buy things for the kids that they really need ! Children are more IMPORTANT than me .....
