LOS ANGELES (Reuters) - A Chicago man who bought Microsoft Corp.'s new Xbox 360 has sued the world's largest software maker, saying the new video game console has a design flaw that causes it to overheat and freeze up.

The proposed class action claims that in Microsoft's bid to gain share in the $25 billion global video game market, the company was so intent on releasing the Xbox 360 before competing next-generation machines from Sony Corp (NYSE:SNE - news). and Nintendo Co Ltd. that it sold a "defectively designed" product.

Robert Byers, who brought the suit, said the power supply and central processing unit in the Xbox 360 overheat, affecting heat-sensitive chips and causing the console to lock up.

Microsoft spokeswoman Molly O'Donnell on Monday said the company does not comment on pending litigation.

Complaints about the problem surfaced quickly on gaming enthusiast Web sites after the Xbox 360 debuted on November 22.

Console owners reported that some systems had crashed during regular use as well as during online game play using the Xbox Live service. Problems included screens going black and the appearance of a variety of error messages.

At the time O'Donnell told Reuters: "We have received a few isolated reports of consoles not working as expected."

She declined to say how many reports Microsoft had received and said that calls reporting the issue to the company represented a "very, very small fraction" of units sold.

The lawsuit, filed on Friday in federal court in Illinois, seeks unspecified damages and litigation-related expenses, as well as the replacement or recall of Xbox 360 game consoles.

most xbox360 owners who bitch and complain that they dont work due to overheating or freezing, etc...shouldn't blame Microsoft but themselves because they are the ones who didn't do it right.

DO NOT switch positions when the disc is inside the console while the power is on, otherwise the disc WILL be scrathed, no joke.

Make sure there is plenty of room for the power supply to breath in, so it would let it cool while the power is on.

Do not plug the power supply into the power strip, but instead just plug it into the wall outlet.

If you want to make your Xbox360 reduce heat problems, keep it hozitonal so that way the heat pipes inside the system would cool faster because the heat pipes in the system is vertical. I keep mine hozitonal, though. It helps gets the water cooler go through the heat pipes faster, that's all.

The console proably do indeed make some noise, and that's because the disc spins so much DAMN faster than other consoles do. MUCH faster than Xbox's disc spin. so thats why the discs are just so warm after you finish playing the game.

there are three colors on the power supply.

orange means standby

green means the power is on

and as for red it means there is a reported error.

certainly the xbox360 is very powerful, but you just have to be very damn careful with that console.

You're right. Some people put it on the carpet. If the fan was on the bottom and the console was placed on a hard surface, there would be a quarter inch of space between the surface and the fan. That way, it has room to breathe. However, if the console was placed on the carpet... the console would "sink" into the surface and the carpet fabric could suffocate the fan. That leads to overheading. I had a similar problem with another console in the past. I don't remember which system though.

Steel, is he total retard?? No I don't think so he is... He is smarter than you thought.. He would get thousands or millions of dollars if he won over M$ for this stupid reason case.. He would be LUCKY enough for himself.. I bet you he would get XBOX 360 after he got millions of dollars from M$ that he won for suing the case... NEVER KNOWS..

Remember that previous one who sued M$ for their fault to cause xbox's power cord was burned house down that person lost.. the One who won and received thousands, thousands of dollars from M$.. see that case person who won already... Now next person who is currently suing M$ case right now... Good luck with Chicago guy who suing and fight the case to win.. :)

he just wants to "steal" the money from M$ without even listening to the gamestore that they said they WOULD get you a free replacement if there is something wrong with your new Xbox360. Just turn it in, tell them about it, and then ta-da! you got an error-free Xbox360.

he's just being a bitch, that's all.
 
Well, he cannot get some shits of what happened to damaged to his games.. He should have carefully read in manual before play brand new system and it does mention, do not leave game running while moving the XBox console up and down and up and down.. it'll scratch the whole game disc.. He asked for it.. He will not win.. :lol:

Similar but softer buzz sound, but not the dramatic buzz saw we had earlier. What do you know, no scratches!
