CHARLOTTE, NC (WBTV) - A federal grand jury charged a Charlotte piano teacher on Thursday with three counts involving child pornography.
David Gerard Smith, 56, was charged with two counts alleging production of child pornography and a third count for possessing child pornography.
A court date for his appearance in U.S. District Court has not been set. He is currently being held in state custody.
If convicted, Smith could face a minimum of 15 years in federal prison on each of the two counts alleging production of child pornography, and up to 10 years for the third count for possessing child pornography.
"Producing and possessing child pornography are serious federal crimes, and offenders will be held accountable for their actions," said Acting U.S. Attorney Edward Ryan.
Smith is currently serving time in jail for another sentence in which he received earlier this year.
In May, Smith admitted to sexually assaulting a 10-year-old girl during her piano lessons with him.
A judge sentenced Smith to three years in prison which is the maximum sentence for the charge.
Ten years ago, Smith was also convicted of molesting his step-daughter.
