Using marker at school leads to OKC teen's arrest
A Roosevelt Middle School teacher made a citizen's arrest Friday on an Oklahoma City student who was caught using a permanent marker to write on a desk.

Perhaps parents need to check supply lists and backpacks before sending their students back to school after winter break.

A 13-year-old was arrested Friday in Oklahoma City, accused of violating a little-known city ordinance that prohibits possession of a permanent marker in some circumstances.

The teen was caught using a permanent marker at Roosevelt Middle School by a teacher, according to the crime report filed with the Oklahoma City Police Department.

Delynn Woodside noted the marker had bled through a piece of paper onto the desk and reported to a police officer that she also had seen the teen writing on the desk with the marker, the report said.

Woodside, a seventh-grade math teacher, made a citizen's arrest on the teen, and the police officer transferred the student to a Community Intervention Center that houses juveniles who have been arrested. The name of the minor was not released.

District spokeswoman Kathleen Kennedy said district officials will look into the incident when students return from winter break, which began Friday.

Under City Ordinance 35-202, it is illegal for any person to possess spray paint or a permanent marker on private property without the permission of the property owner.

“No person may possess an aerosol spray paint container or broad-tipped indelible marker on any private property unless the owner, agent, manager, or other person having control of the property consented to the presence of the aerosol spray paint container or broad-tipped indelible marker,” the ordinance reads.

The law appears to be directed at curbing graffiti and is under the nuisance chapter of city ordinance.

Uh oh...better get rid of the permanment markers that I have in my classroom.
 
Hey, the kid was committing an act of vandalism. Those desks belong to the school system. No different than if he had used spray paint on the building. It wasn't the marker that got him arrested. It was what he was doing with the marker.
 
Sounds like vandalism to me. I hate it when I see vandalism. Although, wouldn't in-house suspension have been more ideal though? Just saying.

That is probably what would have been done in the past. Maybe this is an area that has been subject to a great deal of vandalism, so the law was passed making permanent markers illegal in certain areas. I bet the kids aren't allowed to walk around school with cans of spray paint, either. It is very expensive to clean this type of stuff up.

In the town I live in, someone spray painted a racial slur on a public building in a park a couple of years ago. The city had to come up with $2,000 from an already strained budget to have it removed. The school cannot just leave things on a desk. We don't even know what the kid wrote. Maybe it was a sexual reference, maybe it was a racial slur, who knows? At any rate, it has to be cleaned up. Permanent means permanent. You can't wash it away with a little soap and water.

But that school is public, not private owner.
 
OMG, I would have been been labeled a terrorist back in the 6th grade! I remember writing stuff on the underside of a table with a marker and being made to clean up after myself for doing that. I didn't get supended or anything like that.

Kids at my school would use pockeknives to carve pictures in the desks. Man, the '80s were dangerous times, heh?
 
Nope. School grounds are considered a private area. That is why you have to have permission to even be there.

Right, the school belongs to the taxpayers. Nice of them to steal "OUR" property and claim it as his/her own.

Somebody need to file a "stolen property" claim with the police. :P

No, that would be the Board of Education. The taxpayers don't own the schools nor the properties.

Just because it is owned by the city doesn't make it public property. And actually, it is owned by the school district. The city owns the courthouse, too, but they can restrict what items are brought in.
 
Jeez... what is this world coming to!?

I wrote on my desk with a permanent marker when I was a kid. My teacher simply punished me by having me clean it off myself. After I struggled with not getting it off, she had the janitor do it for me. I learned my lesson. :)

I was thinking the same.
 
I think arresting a student for doing what misbehaving students often do is absurd. The punishment does not fit the crime in this case. At the same time, I think there are much bigger issues of police brutality and uneven justice that we should focus on. I'm hardly giving my sympathy to the student.

Also, not that I think what the kid did was okay, but I would sue the teacher for making a citizen's arrest.

No. The school does not belong to the taxpayers. The taxpayers only fund education.

So should you be granted access to top secret area at the Pentagon just because it was built with taxpayers' money?
