NEW YORK (Reuters) - A judge on Monday invalidated New York City's plan to ban large sugary drinks from restaurants and other eateries, one day before the new law was to take effect.

State Supreme Court Justice Milton Tingling in Manhattan ruled the new regulation was "arbitrary and capricious" and declared it invalid, after the American Beverage Association and other business groups had sued the city challenging the ban.

Mayor Michael Bloomberg had touted the ban as a way to reduce obesity. But beverage manufacturers and business groups had called the law an illegal overreach that would infringe upon consumers' personal liberty.

Dear Justice Milton Tingling, thanks for the thoughts of personal freedom of liberty and happiness despite the fact that they can hurt themselves eventually. Its truly a personal choice not mayor's choice.

Hey Andrew Cuomo, your next! Your signature of that stupid new gun law control... They will be shot down by the bang of a judge.

The obesity in NY is no worse than other states - let look at Mississippi and my state, it is much more.

A large soda doesn't have a lot more sugar than a small one :P

Are you kidding? The nutrient fact on larger soda (2 liter bottle) are based on 8 oz.

If I think right, small would be 8 ounce, has about 4 ounce of sugar, and the large soda as 16 ounce has about 8 ounce of sugar. What does that mean? That means you get same amount of sugar with a large coke as two small coke.

A large soda doesn't have a lot more sugar than a small one :P

That's correct, the nutrient facts are based on how much amount, such as based on 8 oz (for 2 liter) or 1 can for 12 oz soda can.
 
I love Coca~Cola, but I quit about 99% of the time. I still do drink em but not as often as I used to be. Maybe once a month, that is it. I can't take too much sugar anymore.

Of course, I love Sprite because they tastes great.

I didn't drink Sprite so much due to gas issue (made tummy situation little worse) and I have to drink more water. I lost about 60 pounds in 1 year now due to calorie restriction diet.

My weight is 190 lbs. and it is very barely overweight, at closer gap to normal weight.

Yes, if you ban large sodas, people will just buy two small ones :)
 
Yes, it is perfectly legal to tax em when it considers as excise taxes.

No doubt about NYC mayor is really MAD and he should impose the sugar/fat tax, so it will be constitutional instead of ban on larger drink size.
