Man sues Arby's restaurant, claiming he found skin on sandwich

DAYTON, Ohio (AP) — A man is suing a fast-food restaurant operator for more than $50,000, claiming he found a slice of skin on his chicken sandwich.

David Scheiding filed the lawsuit in Montgomery County Common Pleas Court on April 1 after rejecting a settlement offer from GZK Inc., his lawyer said. GZK owns the Arby's restaurant in Tipp City where he bought the sandwich.

Scheiding said he realized something wasn't right when he bit into the sandwich on June 18 and found a piece of flesh about three-fourths of an inch long.

"It looked like I was seeing fingerprints on it," he said. "I got sick and went to the bathroom."

Miami County health investigators talked to the restaurant manager, who had a bandage on his right thumb and wore a latex glove, according to a health district report. The manager said he sliced skin from the thumb while shredding lettuce, and sanitized the area but didn't throw away the bin of lettuce, the report said. Scheiding's sandwich contained lettuce.

"Why wasn't the food searched, and why wasn't it thrown away?" said Scheiding's lawyer, Hank Hyde.

Christine Koeller, vice president of marketing and communications with GZK, said what happened was unintentional.

"(The manager) did destroy product that was in and around the slicer immediately, and did everything that he thought was appropriate to do," Koeller said.

Looks like we have a Wendy's copycat? Read in the paper that the woman who found the finger, planted it herself.
 
hmmm...

Maybe it wasn't planted since the manager did admit that he sliced his finger while cutting up the lettuce, but errmm..didn't throw away the whole lettuce, maybe some of his skin went with the sandwich... :barf:

Cheri, all it says is that the manager sanitized the area where he cut the lettuce at but didn't throw away the bin of lettuce....Now that makes me wonder why didn't he?...

GMTA, Malfy! I thought the same thing when I saw this, too.

This kind of reminds me of that movie "Striptease" with Demi Moore. There's a character by the name of Shad, who was a bit of a con artist/scammer. He'd cook up scams as a way of trying to get rich quick. One of his scams involved putting a cockroach in a container of yougart, and then, claiming it was contaminated. I guess people are following his lead... :lol:

*ahem* Anyway, not funny.

I bet we'll find out this was also a hoax. Time will tell.

We do. But, I also think we shouldn't take everything we see/read on face value, either. As mentioned in another post, the whole "finger incident" was proved be a hoax, and I suspect this will too. People are sick.

I stopped eating at McDonald's after my exwife bit into a big mac and pulled out pubic hair from it.

I think this one is legit. With the Wendy's case, the problem was nobody was missing a finger through the chain....and I believe they still haven't figured out where the finger came from.

With the Arby's, they have a manager who is missing a chunk of skin and basically admits not much was done about it other than sanitizing the area. Kind of gross to think the guy lost some flesh and was probably bleeding into the food and then just wipes it up, sticks on a glove and goes on his way.

I honestly think this customer really did find the chunk of flesh that belonged to the manager.

i agree with you... i believe this case is legit too.. but what really got me off guard is that they didn't "PRACTICE" THEIR HEALTH/SAFETY REGULATIONS... if you dig me... sheesh... i do hope they get a BIG FINE and and fire the manager as well!!! sheesh...

this is one of the reasons why i DETEST eating at fast food restaurants... cuz i have seen gross stuff like this happen... i found a bug in my food on several occasions (different locations ofc), and some kind of hair (not sure if it was pubic or not) in my salad, etc... and also i saw a worker walking out of the bathroom without washing her hands!!!..:ugh:

you would be surprised that many of these workers DO NOT WASH THEIR HANDS after urinating or doing b.m.... so FAAAWWGET IT!! :barf:
 
FeistyChick, you are not alone in this....I remember one worker came out of the bathroom (we were in there) and she did not wash her hands, then she went back to the work area where they cook the food at the restuarant.

Also, my mother said her friend at work went to the local mall with her hubby and ordered from a Chinese restuarant there (in the food court). Well, she said she found a roach in her food! YUCK!!
