TOKYO, Japan (CNN) -- The clicking of dozens of news cameras drowned out the sobs of the 13-year-old girl, but her face explained what was happening in the departure hall of Japan's Narita International Airport.

Noriko Calderon, wearing her school uniform, was being forced to make one of the most wrenching choices of her young life: To stay in the country of her birth rather than join her parents being deported to the Philippines.

The scene was the emotional climax to a story a decade and a half in the making -- one that has tugged at heartstrings in Japan, but ultimately failed to sway unyielding bureaucracy.

Filipinos Arlan and Sarah Calderon illegally entered Japan in the early 1990s on fake passports. They married and had a daughter, Noriko.

Arlan found a stable job working for a construction company. Noriko grew up Japanese, attending school and never learning her parents' native language.

Noriko, like many Tokyo girls her age, loves hip-hop and hopes to be a dancer or a teacher at a dance school someday.

But her future in the only country she's ever known went into limbo when Japanese immigration authorities arrested her mother in 2006.

Her parents decided to fight Japan's notoriously rigid immigration laws and for three years under a harsh media spotlight, they argued their case all the way to the country's High Court, saying Arlan is gainfully employed and their daughter only speaks Japanese.

The family lost their case in the High Court, and Japan ordered Arlan and Sarah Calderon be deported back to the Philippines.

Activists claim Japan's notoriously rigid immigration laws violate human rights. An estimated 500 families are in the same situation according to lawyers, who accuse Japan of not respecting the UN Convention on the Rights of the Child.

Japan's Immigration Bureau in a statement to CNN said the couple's illegal presence in the country as an "extremely malicious" violation that "shakes the foundation of Japan's immigration control."

But when it came to 13 year old Noriko, the government gave the girl a choice: Her country or her parents.

"Japan is my homeland," says Noriko, when asked why she is choosing to stay behind. She will move in with an aunt, allowed to stay in Japan under a visa that the government will reassess yearly.

Her life, say her parents, will be better in Japan. She'll have schooling and the dreams a big city like Tokyo can offer her, versus the impoverished farm community her parents will move back to in the Philippines.

But as the Calderons packed up their small apartment in the days leading up to the deportation, the reality of what would soon happen to the family became more and more harsh.

"Until I'm an adult, I need my parents," Noriko said, her pink cheeks stained with tears.

"We won't be there when she needs us the most," said Arlan Calderon. "She has to protect herself on her own. I'm so sorry about that."

Shogo Watanabe, the Calderons' attorney, collected more than 20,000 signatures in Japan to try and keep the family together in the country.

"Children should be protected when their parents are punished. It's the child's right. But there's no consideration for that at all. I do not think the government is being flexible," said Watanabe.

Under Japanese immigration laws, the Calderons won't be allowed back into Japan for five years.

They've asked for a special waiver to visit their daughter after a year, but it hasn't been granted yet. So their last, public hug could be the last time they see their daughter until she's 18.

It seems like Japan immigration law need change because of Japan facing population growth slowdown due low birth rate and some projection said population in Japan could be decline to 100 million in 2050 but no worse than Russia.
 
This article sounds sad, also it make the immigrants law seems does not work at all the times.

I wonder when will all of the countries would ever get together and take care of all the people and the earth, other things that we should focus than just the religions, ecomony, stuff that we use to be ignorant against the others.

I know Iowa has sent gainfully employed illegals back to Mexico and in some cases where the wife was a citizen, she and the kids stayed here.

We are not that humane either.

yea but difference is.... Japanese INS was merciless despite of heavy media attention. In here - the government usually succumb to it. The Japs wouldn't even give them a special circumstance (a little extension) or whatsoever. It was basically a "GTFO"

Japan is overpopulated. It would be a great thing for them to go down to 100 million.

Not always the immigration control is in response to population control. Asia's getting hit hard with this poor economy so in response - its immigration law was tightened up to protect its domestic jobs from being filled up by cheap foreign labors.
 
Look at Tokyo metro, it's almost 35 millions population. It's ultra-mega city in the world.

Heck! That city beat Canada's population which is over 33 millions population. :shock:

I have agree with Jiro, it's not reason because of overpopulation.

There's no official if overpopulation has been issue by Japanese government.

Wrong, asia isnt hit at all, they're MILKING it !! but yes cheap foreign labours the blame goes to the koreans, (South Korea have the fastest rate of new millionaires/billionaires) and blame China for pinching as well.

we ought to get rid of free trade, its bullshit and more bullshit , moreover the 'war or terrorism' is just a smokescreen to distract us away from the reality of impacts stemming from free trade. who ever invented and commericalised the concept of free trade ought to be shot.

Never will happens in our generations, even our great grandchildren's generation. Look at friggin' Middle Eastern. It doesn't make any sense for some psycho extremist Islam guys to yell "Allah" with their bomb vests on for the 72 virgins. Is that how they gonna care for themselves? Yeah, we're fucked up in this world.

We already have law for illegal immigrants, it was passed in 80's.

If you want to restrict of legal immigrants to our country then you would have deal with low birth rate, our birth rate in US is very low and economy wouldn't able to expands or increase of strength if our immigration law is extremely restricted.

In Japan, it's impossible for you to immigrate in Japan without any sponsored by your job, even if you are immigrant and live in Japan until you lose the job or sponsor then you will be deport to US.

Bush's immigrant laws are totally different from Japan because Bush's immigrat law is just increase of restrict on illegal immigrants only.

There's reason because Bush has changed the fiscal policies about immigration service and Bush is just more cares about war in Afghan and Iraq over worries about illegal immigrants.

It's not cruel because illegal immigrants are illegally wrong and supposed not cross into our country without get permission from immigration service or make information to immigration service after board into US for asylum reason, such as political issues like disagree or bad treatment with communist government, dictatorship and unstable government system.

In Mexico, there's democracy in government, personal freedom and economy is getting better, it's in advanced, closer to being developed country then no excuse for illegal immigrants to cross into US, except for some reason when some families have issue with drug trafficking or drug cartel then I would understand, even Mexico government is responsible for funds on securites in their country.

They once used to be closed minded people, yeah, but I just hope that they would change. That's my faith for people :)

Doesn't the Bush family have a relative that came from Central America illegally ? They ended up marrying into the family. :hmm:

Yup, Tokyo metro is ridiculously overpopulated. The train there looks scary, everyone seems to be all squashed in there. :shock:
