A Los Angeles probate court on Monday approved a request by Michael Jackson's mother to take guardianship of his three children, CNN has confirmed.

Michael Jackson's father, Joe Jackson, told CNN on Sunday evening that he and his wife expected to keep the children.

An autopsy was performed on Michael Jackson Friday, and toxicology reports from his body will disprove rumors that the singer's personal physician injected him with powerful painkillers, the attorney for Dr. Conrad Murray said Monday.

"Dr. Murray never prescribed Demerol, never administered Demerol, never saw him -- Michael Jackson -- take Demerol," attorney Edward Chernoff told CNN's "American Morning."

"And that goes as well for Oxycontin. I think those are just rumors. When toxicology comes back ... that's going to be all cleared up," Chernoff said.

Murray met voluntarily for several hours with detectives over the weekend, the Los Angeles Police Department said late Saturday.

"We've let them know we're available to them any time they need us, any questions they have," Chernoff said. "We have told them that the medical examiner is free to call us. We'll be available to them. If they have any questions once toxicology comes out. I expect they will have some questions, and we'll be ready to answer them."

Murray found Jackson not breathing in bed when he entered the 50-year-old singer's estate on Thursday, Chernoff said. Jackson did have a slight pulse when Murray found him and tried to resuscitate the singer as he awaited paramedics, a representative with Chernoff's Houston, Texas, law firm said Sunday.

Jackson was rushed to a Los Angeles medical center, where he was pronounced dead.

An autopsy performed by a county medical examiner was inconclusive, although officials said there were no indications of external trauma or foul play. The Los Angeles County coroner's office has said toxicology results are needed before a cause of death can be determined. That could take four to six weeks.

Detectives impounded Murray's car, which was parked at the singer's rented home. Authorities said the vehicle may contain evidence related to Jackson's death, possibly prescription medications. Police have released no information on what they may have found.

Chernoff said there was nothing in Jackson's medical history that Murray was aware of "that would lead him to believe he would go into sudden cardiac arrest or respiratory failure."

"There was no red flag available to Dr. Murray, which led him to believe he would have died the way he did," Chernoff said. "It's still a mystery how he died to Dr. Murray.

"It was Dr. Murray ... as you know, that requested that the family ask for an autopsy, because he needed to know as well as his physician what caused Michael Jackson to stop breathing."

The documents filed Monday in Los Angeles state that Jackson's mother should be appointed as the estate's administrator.

Joe Jackson has joined in the petition to try to designate his wife as keeper of the pop icon's estate.

Superior Court Judge Mitchell Beckloff granted Katherine Jackson temporary guardianship of the children on Monday. He also scheduled a hearing for Aug. 3 on Jackson's petition to become permanent guardian of her son's children.

Michael Jackson died Thursday, leaving behind three children: Michael Joseph Jackson Jr., known as Prince Michael, 12; Paris Michael Katherine Jackson, 11; and Prince Michael II, 7. The youngest son was born to a surrogate mother.

In the request to take over the children's estate, Jackson, 79, lists its value as "unknown."

The filing lists the children as living at the Jacksons' family compound in Los Angeles' San Fernando Valley.

"Minor children are currently residing with paternal grandmother," the filing states in an explanation of why Katherine Jackson should be appointed guardian. "They have a long established relationship with paternal grandmother and are comfortable in her care."

The filings provide no other declarations by Katherine Jackson, nor do they state whether Michael Jackson left a will.

TMZ.com reported that Jackson's lawyer has a copy of the singer's will and he intends to file it with the court.

The filings note that Deborah Rowe is the mother of Jackson's two eldest children, but list her whereabouts as "unknown." An e-mail message sent to Rowe's attorney seeking comment wasn't immediately returned Monday morning.

For Michael Jackson's third child, nicknamed as Blanket, the filing states "None" for the mother.

CBS News correspondent Ben Tracy reported that the significance of this statement comes on the heels of sentiments spoken by other Jackson associates who have expressed interest in custody of the singer's three children.

Prior to meeting with the family of Michael Jackson to discuss memorial plans for the late singer, the Rev. Al Sharpton (who attended the BET Awards Sunday with Joe Jackson) spoke about custody of the singer's children.

"I know that generally the entire family - I've been talking with Mr. Jackson and certainly Jermaine and the brothers - everyone is concerned about Michael's children and will do what is necessary to make sure they're provided for properly and provided for in a way that Michael would have wanted them to be provided for," Sharpton said.

The court documents state that Katherine Jackson "intends to marshal assets of the decedent for the exclusive use of the decedent's three children — her grandchildren — after payment of debts and expenses of administration."

Earlier, Superior Court Judge Mitchell Beckloff granted Katherine Jackson's request to assume temporary guardianship of her son's children but did not immediately rule on her request to administer their estate.

Beckloff scheduled hearings for July 6 and Aug. 3 to take up the matters, including whether to also approve a request by Jackson to become permanent guardian of her son's children.

So far a will for Michael Jackson, which might spell out his wishes for care of his children and his estate, has not surfaced.

Jackson, 79, is seeking control of the estate to protect her son's legacy, according to a person close to the proceedings who was not authorized to speak publicly on the matter and requested anonymity.

"It's apparent that the family doesn't want Mr. Jackson's estate controlled by anyone other than Katherine Jackson and the family," said the person, adding that the family is trying to make sure no other business or legal adviser tries to step into that role.

The attorney, Marta Almli, wrote in a statement Saturday that "Ms. Rowe's only thoughts at this time have been regarding the devastating loss Michael's family has suffered. Ms. Rowe requests that Michael's family, and particularly the children, be spared such harmful, sensationalist speculation and that they be able to say goodbye to their loved one in peace."

For Jackson's youngest child, nicknamed Blanket, Monday's court filing states "None" for the mother. It also states that all three of children "have no relationship with their biological mother."

The court filings show that family attorney L. Londell McMillan has joined a team of lawyers to coordinate the family's attempts to take control of Jackson's affairs.

"I don't think there will be anybody who thinks that there is someone better" than Katherine Jackson to have custody, McMillan said Monday on NBC's "Today" show. "She is a very loving host of other grandchildren."

McMillan also said the family was "quite clearly troubled" about the circumstances surrounding Jackson's death, adding he had been healthy enough to be rehearsing for 50 upcoming concerts just days before his death.

Asked whether the family suspected foul play, McMillan said those words were "too strong an indictment."

Edward Chernoff, a lawyer for Michael Jackson's doctor, Dr. Conrad Murray, said in an interview Sunday with The Associated Press that Jackson still had a faint pulse and a warm body when Murray found him in bed and not breathing Thursday afternoon.

Chernoff said Murray was at the pop icon's rented mansion when he discovered Jackson. The doctor immediately began administering CPR, Chernoff said.

"He just happened to find him in his bed, and he wasn't breathing," the lawyer said.

Chernoff said his client never gave or prescribed Jackson the painkillers Demerol or OxyContin, and denied reports suggesting that the doctor gave the pop star drugs that contributed to his death.

Los Angeles County coroner's officials said their autopsy found no indication of trauma or foul play. But because of additional tests, an official cause of death could take weeks to determine. Jackson's family has requested a private autopsy.

Once the investigation is completed, Chernoff said, he expects Murray to be exonerated.

At the Jackson family's San Fernando Valley compound crowds of fans continued to gather Monday as numerous relatives remained secluded behind the gates. Funeral plans were still under way.

Jackson never told his family who he had in place to handle his business affairs, a person close to the family told The Associated Press last week. The person, who requested anonymity because of the delicate nature of the situation, said they were told by the singer's phalanx of advisers that he likely had a will, but it may be many years old.
 
I remember reading Michael Jackson talking about how abusive his father was.

Hope he won't be too involved with the children.
 
It is well known Joe Jackson was abusive and presumptuous. I disagree with the judge's decision on giving temporary guardianship of MJ's children to Katherine Jackson. I'd rather them go to a stable guardian.

A custody battle may be brewing over the future of Michael Jackson's three children. Just four days after the singer's sudden death on June 25, Jackson's mother, Katherine, has filed a petition in Los Angeles Probate Court seeking legal guardianship of Jackson's three children.

"Joe and Katherine Jackson want those children!," a source close to the family tells PEOPLE.

Jackson had two kids – Prince, 12 and Paris, 11 – with ex-wife Debbie Rowe. His youngest son, Prince Michael II, 7, was born to an unnamed surrogate. Although Rowe is still the legal parent of the two older children, her next step is unclear.

"Debbie sent her condolences, and said she was not going to do anything about the kids ... yet," the family source tells PEOPLE. Still, "Joe and Katherine think she's going to come after them."

Katherine Jackson's 22-page petition claims the children "have no relationship with their biological mother" and have been in the care of their grandmother, "with whom they have a long established relationship," since Michael's death. A hearing on the petition has been scheduled for August 3.

Experts in California family law say the grandmother's petition could be granted – as long as Rowe, who is the sole surviving legal parent of the two older children, has no objection. If Rowe does object, the Katherine Jackson could face an uphill battle to prove the kids would be better off in her care, no matter how close she is to them.

"[Rowe] is the biological mother and upon Michael Jackson's death, technically she has every right in the world to have custody of those kids," Los Angeles family attorney Michael Trope tells PEOPLE.

The petition for guardianship was filed in Katherine Jackson's name alone. Joe Jackson, 80, maintains a separate home in Las Vegas but also spends time at the family house in Encino.
