Pete's right; they're cowards. They hide behind the letter of the law (when convenient), behind religious freedom (when convenient), and behind religious authority (when convenient).
Funeral
A funeral should not be hijacked by anyone for religious, political, and/or personal agenda(s). The soldier never went to the Westboro Baptist church nor has he met any of the Phelps cult members. The church (Topeka, KS) used a stranger's death in Westminster, MD to further their own goals. That's not freedom; that's fascism.

Fred W. Phelps Sr., Westboro's founder, vowed to appeal to the U.S. Court of Appeals for the 4th Circuit, in Richmond, Va.
"It's going to be reversed in five minutes," he said. This case, he added, "will elevate me to something important," as it draws more publicity to his cause.
Obviously, the stranger's funeral was hijacked for Phelps' delusion. Again, they did not know nor had they ever met the solider!
The judge overseeing the case was right when he instructed the jury,
"You must balance the defendants' expression of religious belief with another citizen's right to privacy."
Politically
The ACLU (Phelps says they're going to hell) managed to get the Supreme Court (Phelps says all the judges are going to hell, too) to overturn state laws banning protests at funerals. The ACLU is equally vilified by the Democratic and Republican parties. The Republicans use the ACLU as a reason for people to give money to the Republican party. Religious organizations with their Falwells and Robertsons, also pander to this method.
Socially
It does not matter how many laws are made; one cannot legislate what people think and feel.
The best weapon against people like Phelps is education, education, education.
Personally
I trust a Man of God when he is surrounded by love; I do not trust a man who is surrounded by lawyers.
