Attorney's for Oswaldo Martinez, an illegal immigrant from El Salvador who is charged with raping and killing a 16-year-old girl in a James City County mobile home park in 2005, met with prosecutors and a Circuit Court judge Tuesday to discuss and get an update on his competency to stand trial.

Martinez, who is facing capital murder charges, is a deaf and mute man who is working with officials at state mental hospitals to learn sign language so he can communicate with his lawyers to stand trial.

His attorneys said he is at Central State Hospital in Petersburg.

Circuit Court Judge Samuel Powell ordered that a treatment plan, which will show Martinez's progress in learning to communicate with his lawyers, be turned over to his attorneys next month. Powell did not set a date for Martinez's case to go to trial, but he did schedule another competency hearing for October.
 
Then it's El Salvador fault for lacking education system to recognition on disability people.
 
Why aren't they using a CDI to assist with communication?

However, I do applaud this judge for having the understanding that ineffective communication leads to unfairness in legal procedure.

But he killed young girl, he should be gassed whether he is deaf (not mute, this is bs) or not.
 
he has to have a fair trial...we cannot prosecute someone who does not understand the charges....so I figure they'll probably declare him mentally ill and probably send him to a mental institution. No matter the crime...it's horrific I know, but it's the way the laws work.

Gives the deaf a bad rap! Still, he's innocent until proven guilty.

Many people get off by pleading insanity....get locked up for a few years, then they release them, free as a bird.

I knew many deaf adults who does not have any language alike him and they do know the difference between right and wrong. This man is no different from other SVP (sexual violence predator) and killer, they have no consicious.

U think he is mentally illness? Should SVPs spend whole their life in mental illness hospital? No thanks, he should spend time in prison alike rest of killer and get death penalty. I don't buy it, he does not understand. He knowswhat he did was wrong.

So do I. I just hope the judge does not pass whatever judgement and add "Let this be a strong message to the deaf community that this sort of behavior will not be tolerated..." That would be discriminatory, but it happens.

I don't give a rats ass if this guy is deaf. He is 33 years old, 5'4", 130lbs. The cops have enough evidence (including DNA) to bring him to trial for the rape and brutal murder of a 16 year old girl. This bastard should be going directly to the gas chamber. His incentive to be educated in sign language is to go stand trial for murder and possibly the death penalty. I don't think it takes a rocket scientist to see that this is headed nowhere. This fuck will probably get stuck in legal limbo and never stand trial. Fariness is one thing but come on people. The evidence is overwhelming. Read for yourself. Please Vampy. I don't think you need to be taught anything to know that raping and killing is wrong. Holding your hand over someones mouth while you strangle them and they are kicking and screaming and scratching for their life shows a blatent disregard for human life. Now I would agree with you if that sort of thing is commonplace and everyone is doing it. Then one might think its ok, but.....I'ts not really commonplace. I dont' see young girls getting raped and brutally murdered everytime I turn around. I don't believe that happens in El salvadore either. But I could be wrong.
 
After reading this, I agree, he's guilty. IMO, if they don't keep him locked up, he'll do it again. With no education, verbal or signing skills, he feels no guilt or remorse, no feelings, just takes what he wants. His mind "locked in" to nothingness. Like an animal in the heat. He's a rapist and a killer.

There was another well known case like this , a deaf mute was found guilty for killing a man.
The deaf man did not know sign language and no one took the time to teach it to him before his trial and people believes the guy was also mentally challenged. The guy was found guilty and send to jail for life. Another lawyer heard about this case and was able to prove the deaf guy WAS NOT guilty and he was not mentally challenged. A movie was made about this story.

The evidence in this case seems clear that this guy IS GUILTY!
 
He did manage to make his way from El Salvador to the US alone, communicate needs for food, cigarettes, handle money.

Was literate to the point of writing his name when requested in a language foreign to him.

Knew his brother's name.

He was not completely without language.

He had to know right from wrong, or he would not have committed the crime secretively.
 
Well illegal immigrants are known to play the launguage barrier game to get the courts to feel sorry for them.

I know of several that know English and when they get in trouble with the law or whatever they play like they don't know any English and out of frustration the officer lets them go. They usually get pulled over for driving stupid.

Like mentioned before the guy made it all the way to the States from El Salvador. He had to know something. He had to know something or he never would have survived the journey. You have to have your wits about you in order to travel that far on foot. This guy is toying around with the justice system. He obviously knows right from wrong. That's not the point. It's that he somehow got up here without a language and now he he's going to a hearing to decide if he's competent enough to stand trial? It doesn't make sense. Language doesn't equal competency. Animals don't have a language yet they are competent enough to survive out in the wild. If this man is literate, then, he should have real-time captioning in the courtroom in his language - written spanish.
