Deaf-mute still not ready to stand trial -- dailypress.com
Attorney's for Oswaldo Martinez, an illegal immigrant from El Salvador who is charged with raping and killing a 16-year-old girl in a James City County mobile home park in 2005, met with prosecutors and a Circuit Court judge Tuesday to discuss and get an update on his competency to stand trial.
Martinez, who is facing capital murder charges, is a deaf and mute man who is working with officials at state mental hospitals to learn sign language so he can communicate with his lawyers to stand trial.
His attorneys said he is at Central State Hospital in Petersburg.
Circuit Court Judge Samuel Powell ordered that a treatment plan, which will show Martinez's progress in learning to communicate with his lawyers, be turned over to his attorneys next month. Powell did not set a date for Martinez's case to go to trial, but he did schedule another competency hearing for October.
