If someone assaulted you, would you want to then cheer for his performance on a basketball court? A 16-year-old Texas high school student sure didn’t.

High school football star Rakheem Bolton and two others were indicted for sexual assault of a child–identified only as H.S.–at a post-game party in 2008. According to H.S.–a fellow student and cheerleader at Silsbee High–Bolton, football player Christian Rountree and another juvenile male forced her into a room, locked the door, held her down and sexually assaulted her. When other party-goers tried to get into the room, two of the men fled through an open window, including Bolton, who left clothing behind. Bolton allegedly threatened to shoot the occupants of the house when the homeowner refused to return his clothes.

In September 2010, Bolton pled guilty to a lesser charge of Class A Assault and was sentenced to one year in prison, a sentence that was suspended by the judge in lieu of two years probation, a $2,500 fine, community service and an anger management course.

Silsbee school officials had two responses to the incident. First, they urged H.S. to keep a low profile, such as avoiding the school cafeteria and not taking part in homecoming activities. With the support of her family, she refused to do so, rejecting the notion that she had anything to be ashamed of. Secondly, school officials kicked her off the cheerleading squad for refusing to cheer for Bolton. No kidding.

Bolton had been allowed back on campus during a brief period when one grand jury withdrew the charges before another grand jury reinstated them. During a basketball game, H.S. cheered for the entire team but refused to cheer “Rakheem” during his free-throws, so she was off the squad.

H.S.’s parents sued the school for violating her right to free speech, but an appeals court dismissed her case earlier this month. The bizarre reasoning: “In her capacity as cheerleader, [she] served as a mouthpiece through which the school could disseminate speech–namely, support for its athletic teams.” Not cheering for Bolton “constituted substantial interference with the work of the school because, as a cheerleader, [she] was at the basketball game for the purpose of cheering, a position she undertook voluntarily.” In other words, the “work of the school” is basketball, and H.S. was obligated to put on a robotic smile and cheer for the man who had assaulted her.

Silsbee High School officials should be held accountable for their actions. Richard Bain, Jr., the superintendent of schools, allegedly ordered H.S. to cheer for her attacker. Wait a minute, the officials is actually saying that the victim should not go to cafeteria and should have low profile even though the rapist was CONVICTED? Why should she be the one to be punished for not going to cafeteria or being low profile? Shouldn't that rapist BE kicked out?!?!

That is so wrong on all levels. The officials should be fired.

Was the assault charge related to threatening to shoot, or rape?

I reread that section. The threat against the homeowner was called "alleged" so I don't think it went to trial or was even indicted. That means, the assault charge to which he plead guilty was the attack on the cheerleader.

I wonder if she can apply for a restraining order, so he would be forced to transfer to another school?

She may apply, but I think the school would kick HER out because of the RO just to protect their star player.

I would like to know what happened to the "two others".
Strange as it is, this happen an hour from Houston and Houston high school teams regulary play Silsbee teams in all sports. And yet, nothing about this was reported in the Houston news....if it had been, I would have known about it.

KOUNTZE — A southeastern Texas grand jury has indicted two Silsbee High School students in the alleged sexual assault of a school cheerleader.

The indictments charge 18-year-old Silsbee player Rakheem Jamal Bolton and 19-year-old former player Christian Paul Rountree on single counts of sexual assault of a child. Bonds of $250,000 were set for each, but a Hardin County Jail official says neither was in custody as of Tuesday afternoon.

The alleged attack came at a post-game party in October 2008.

If convicted, each could be sentenced to two to 20 years in prison. The indictments come from the second Hardin County grand jury to review the case. A previous grand jury declined to indict in January.

Considering these cases, one of them is a Star player with most likely rich parents who hired a very pricey lawyer to bury this case, or at least sweep in under the rug in some degree.

This isn't the first time a student walks from a hideous crime. We got some kids here near my city whom all live in million dollar homes that sexually assaulted a student in the gym locker and they are most likely will walk away from it all and end up going to Harvard or some Ivy League college.

As the old saying goes, "Money talks, bullshit walks".

She can sue the school and she should sue the school.
 
It's sad that the treatment of rape is still driven by the dark ages, worse still, alot of the female "jerks" out there that cries "rape" as a means of getting revenge on someone that they don't like makes the rest of the legit victims look bad.

Like the story I posted a while back regarding a taxi cab driver who kept a cam in his car dashboard that recorded the females threatening to call the police and cry rape if the driver didn't let them out of the cab fare that they owed.

Nonetheless, when someone cries rape, doesn't mean that the case should be looked at sideways. All cases of rape should be treated with equality until they find otherwise.

I'm sorry but this is a SEX OFFENSE. AND it was a GANG rape! It wasn't a "misunderstanding" or a revenge thing! Sorry, but this sounds exactly like the Our Guys gang rape, when an intllectucally disabled girl was gang raped by a bunch of arrgogent jocks.

Without knowing all the facts, I am hesitant to say it was a sex offense.

If he assaulted her sexually, he needs to be in prison, not playing HS sports.

If it was consensual, different story. Was she telling mom and dad she was assaulted when they were discovered? There are too many unknowns.

If she had been my daughter .... I would have taken the threats he made of shooting me and my family very seriously. Because he made those threats and acted in an aggressive manner, I would believe he had done the same to my daughter .... just saying.

So yes, she needs to sue the school.
 
remember duke lacrosse ? everyone jumped on the guys for rape when it was not. i would have to go with the law on this too. not enough facts even though i would love to see a rapist hung by his balls. not enuff real evidence from the article.
