Anyone know how to evict a roommate?

The person is on the same lease as me and shes paying rent. however, she has taken advantage of my friend who was drunk- took advatage of my brother (at most TRIED, i put my foot down immediantly and she flipped out defending "their relationship" me bro wanted NOTHING more than friendship) whilst she was going out with my good friend, stole my plates, bowls, and a book (police report made) and she leaves her old dishes and food out to sit and rot and mold and wont listen when i tell her to please clean. She has obnoxious friends over constantly and one of them assualted my boyfriend who is also a paying tenent. I live in michigan and my landlord refuses do it anything claiming it to me a "silly squabble" but I swear this girl is manic depressive and is wronging me left and right. what do I do?!

please help!
 
one suggestion - you can find someone else to move into your place. I have heard that for some place - the lease agreement forbids that... a non-transferable contract. For now - nothing you can do about it....

sorry. the cold hard lesson here is to choose your roommate wisely and carefully next time... which I did and it worked for me every single time.
 
I'm sorry to say this but this forum is the wrong place to ask for a resolution when there's three sides to a story. Your side, her side and the truth. Remember you do need to go through the proper channels of an eviction otherwise you can face a lawsuit of an illegal eviction. The landlord does sound right, a silly squabble can be easily solved by communicating. Try to think outside of the box without getting emotionally involved and consider this as a learning experience as you go along. This will teach you to reconsider choosing better roommates next time, aye?? Smile.
 
Looks like you will need to find another place, but if you want to stick it out, find out how much notice in time you need to give a tenent before you can legally remove them from the premises. Your landlord (or property owner) must do this as renters have no leeway to initiate an eviction - except under serious circumstances (breaking a law, breach of contract, etc.).
 
I couldn't tell if you were being sarcastic or not, but if you truly think your roommate is bipolar (manic-depressive is the old term for this illness), I would suggest that you ask her to seek help from a psychiatrist.

If she is bipolar, medications and/or talk therapy can help her better control her behavior.
 
Once the lease is ended then you can move to another place or find another roommate. But be wise to choose the right roommate. I know it is such a pain but there is no choice once you signed the lease agreement til it expired.
 
Did you ask your landlord for the permission before you accept her/him as your roommate?
 
Move yourself out, and let your roommate screw up and damage his/her credit of record.
 
Tell your landlord you think that your roommate's habits (or lack thereof) have created an unsanitary living condition for you. Mold growth, bugs, etc are NOT a good thing. Tell the landlord you want a health inspector in to look over the building and living conditions. Seek legal counsel. Most cities have free legal services and can offer advice for things like this. Landlords don't want to have to pay/deal with a health inspector. Might get him to take action.
 
Take pictures or video of all the shitty things she do... and show the LL.
If that doesn't work, ask her to leave voluntarily.
If she won't... make it unpleasant for her to stay :lol:

I'm not sure what state are in but if you visit your local courthouse (in person or on-line), you should be able to find the information you are looking for with the eviction process.

Every state is different but will give you the run-down of maryland so you have an idea of what happens.

First, you would have to askt he roommate to leave. If she refuses, then one would go down to the local courthouse and file the eviction paperwork. Part of that paperwork includes a notice that needs to be served. It gives them 30 days notice of the eviction. They can either then move, or fight the eviction. If they fight it, then it goes before a Judge and the judge decides on if the eviction is proper...and if so, the sheriff will go and force them out. Again, this is how Maryland works and I'm sure your state will be different.

Something to keep in mind is that if it goes to court, there is no need to mention about the squabbling and flirting etc. The thefts, the assault, and not cleaning after themselves is somethng the court would be interested in. Some have said that you should find another place to go and leave the roommate behind. The problem with this is you would then be violating your end of the lease, screwing up your credit, etc. If your landlord will not assist in getting them out, then ask the landlord if he/she would let you out of your half of the lease.

Don't go to the court, you won't win, she won't win, just go to craigslist classifieds: jobs, housing, personals, for sale, services, community, events, forums and post up your swapping lease. It'll be fine, there's a lot of people out there who's willing to kick your roommate's ass.

I couldn't help you but one of my friend battle with his ex roommate by police etc.. :roll:

Actually, on many leases, you cannot swap or sublet. Read the fine print in your lease before you do anything on CraigsList.

Fuck the fine print, I've done it more than once against the landlord's decision and they can't do anything, because the next tenant pays their rent and the landlord likes the money.

Stop posting illegal advice. The landlord CAN take legal action.
