County prosecutors have charged a 17-year-old boy with assaulting a deaf man.
Police originally arrested the boy and an 18-year-old companion on suspicion of a hate crime, alleging they attacked the victim because of his disability. But deputy district attorney Daniel Cabral said the two and the victim had argued before.
"It didn't appear to be a hate crime," Cabral said. "It appeared that there was a prior history between the two people and the victim."
The 18-year-old, Phillip Hale, was not charged with any crime. Prosecutors sent his case back to Antioch police for further investigation.
Antioch police said that in the early hours of Sept. 9, the two were walking by a home on the 3400 block of Longview Road where a group of deaf people were attending a party. The duo taunted them with exaggerated sign language gestures.
The teenager and Hale left, but returned with a stick, a hoe and a concrete brick and attacked a 23-year-old man, police said.
The teenager is charged with assault with a deadly weapon.
