Yes Paul, it's called negligence and liability although most cases don't make it to trial because people settle. *just like this case probably will never make it it trial because they'll settle* When you are aware that something on your property requires maintenance and is a danger, say a roof, and you don't a) fix it or b) warn people about it then that is negligence. If someone is hurt, even a burglar which in civil cases is classed as a trespasser, because of your negligence than you are held liable. Yes, that's how it works. If the case does make it trial they might not win, just like if this case makes it to trial they might not win.

The point is that once a burglar enters, s/he is at own risk. A judge will say that, too.

I get it that you have already decided that he doesn't deserve it but it doesn't matter because you are not a juror.

There was case of a woman getting obscene phone calls so she got a real whistle and the next time the jerk called she blew the whistle into the phone and harm the guy's ear. He sued the woman and won. This was a long time ago so I doubt if on line. If a burger fall on ice trying to break in your house they can sue you. I know it does not sound fair but can happen.

Do you expect a homeowner to put salt on ice around the house in 2 am so a burglar can break in safely at 3 am? What planet are you from?

Where the HELL did I say a home owner had to put ice on the steps at 2 AM???? What are you smoking??? I am saying if a burglar get hurt falling on ice , get attack by the dog etc , they can try to sue. And burglars will beak into a house at all hours of the day and even when people are home. You're are very naïve if you think burglars only break into the house in the early hours.

If burglars try to break-in = death penalty by gunshot, by citizens, not law enforcement officers.

There is castle doctrine law that immune you from civil and criminal lawsuit for kill the burglars.

Can a burglar sue a homeowner for suffering and pain from falling on ice while trying to break in or falling down from broken stairs when he was burglarizing inside the house?

I posted a guy sued a woman he been stalking over the phone and she got a whistle and blew it right into the phone and the stalker sued the woman .
