What would you do if you told landlord to wait to cash the check for rent til rent due date because you don't have enough money. But he or she cashes it anyways.. and you find out you have overdraft charges and he cashed it before the rent due date? It happened to me and Jeremy.. :mad:

Well, your landlord has to pay the debts, such as apartment loan/mortages, property taxes, uliities expenses, maintenance expense, emergency loan for replacing/repairing equipment/building.

Your landlord only earns little profit. You have to pay overcharge checking service fee.

You need to discuss with your landlord to change the date of due rent.
 
Did you say BEFORE due date? Then the landlord has to be responsible for overdraft fees, etc.

I collect rents from over 60 people each month and would not cash their checks until due date unless they tell me to go ahead.

If you don't have money in your account, don't write the check. It is illegal to post date checks, or to write checks for which your account has insufficient funds.

Nope, landlord has right to cash the check. I bet FelixKat930 wrote the actually date on the check. It seems perfect logic. If she wrote "June 4" then the landlord cashed on that date instead of next few days.
 
Then simply give your landlord the check ON THE DUE DATE so that he wont cash it BEFORE due date :dunno:
 
He cashed it before the due date.. but we wrote the check for the date today. Maybe bank let him do that?
 
We had some money but not enough for the rent til Jeremy's paycheck comes on every Wednesday.

If, I were in your shoes -- I wouldn't give the landlord the check UNTIL the rent is due. It will save my headaches.

I recommend you go over bank.. file complaint why bank allow person cash it out early the date.. not follow the date!

File complaint report.. then they'll look into the cheque date and $ and will regarding forward to your landlord.. Has to pay you back for NSF refund charge.

That pure simple but don't know usa system bank works?

In Ontario.Canada does have prorpite ways, banks tellers must must read careful w/date first before deposting their bank account.. If misplaced the date.. Teller and person are responbile for that damages... further discussion file complaint report...

I agree...I just can't stand to be worried about it if I give it to the landlord early. I rather to wait until the rent due then I will give it to them. For my apartment, if we don't pay after 5 days it usually charges me for 5 dollars but I never pay late. I always paid on the right time though.

your landlord shouldve respect your wishes...im curious why did you give it to your landlord early check? was it because you and jeremy were gone for out of town or something?

you should go to the bank and file complaint about the date you wrote.. :dunno:

My landlord is great with us!Don't pay the rent till it's due or have enough money!

The rights of apartment manager

I understand that should base on post check. Did the she/he said ok about post check or you just drop box the payment where the manager's office?

If not then that would be you but if you come face to face and explain this post check due your whatever reason. If you don't mind late fee then hold on until you have money.

I never give my landlady the check until the 3rd of each month, so I don't have to worry about her cashing it early. The 3rd is the day the rent is due here.

Last month.. I found out our landlord's bank is same as ours..
He found out too, asked us .. its easier .. for him and us.. to have
our funds transfer to his funds acct..
its our second time, its nice.. hassle free.. worry free.. and on time :)

we already agreed to set which date of month.. 5th.. I already had my banker fix .. on 5th, it automatically transfer to his funds..

or.. you can ask your bank automatic funds sent to landlord.. like you have some bills debit your funds, bank sent to bills.. try that?
