I did change their names for private matter.. The woman name is umm Kathy I knew her and believe that she has something mental in her mind! :roll: Anyway, I learn that She borrowed money from another man name is um .. David. Owe several thousands dollars! She began to hides and avoid to contact with David. As a result, David decides to contact with lawyer and soon take her to court.

I am asking>>> What if David is winning the court then what happen to Kathy?? Because Kathy does not have any money. She is still under her parent's roof. :hmm:
 
David made some dumb decision.
I hope David have some evidences, like anything related to money that went to Kathy.
If David do not have any evidences, the court is adjourned.
 
Right, if David has any proof that he gave her that amount of money, or has a written agreement between Kathy and him, that stated she will pay him back the loan then yes he may win the case, if he doesn't then he will have to firgure out a way to prove that he gave her this money. If the judge finds that she does owe him money, she will be force to pay what she owes whether or not she lives with her parents and has no income, she should have thought about this first before borrowing money from someone.


When I borrow money, I pay it back, it's the right thing to do.

I agree with Angel. As long there is evidence to prove that she does owe him the money. Like date, money order, check write out in her name. It can be anything in writing. She think she can get away with it then that is wrong.

I know one woman does that too. I am not sure if she mention the same woman or not.

I knew someone who did that too, he didn't think his ex would get a photocopy of the cashed money order but she did, and he was badly busted :giggle:

Kathy does not have any money, She doesn't work and on SSi, she is about 40ish and still live under her parent s house.. She doesn't have anything own property value? She has her car's over mileage and broken down on her parent's yard!

I think that David is waste time to take court ? :dunno2: Am I right?

Did David and Kathy made agreement contract before he lend $$$ to her? If yes, then is a good chance. If not, then is a bad chance.

Sure, David has a good chance but... but... but... the problem is Kathy has no money to repay back what she owed him? The court would say: Wait until Kathy get job then...
 
I believe if they both have a written agreement put on paper and signed by Kathy then david would have good chance of busting her in court but if there is no agreement then its gonna be hard for him to get his money back.

Phillips, I'm not a lawyer, but to answer your specific question, I checked with a lawyer at my gun club (no, we don't use him for a target, yet).

He says that depending on the state laws where the judgment was made, IF David wins a judgment against Kathy, in small claims court, for instance, then he may file papers creating a lien against any of Kathy's future income, including tax returns, and even against any property she owns. Thus, even if she lives at home and has no income, she can never sell anything she owns that has a title, unless she first clears the debt to David.

What the lawyer tells me is that even if Kathy has no money now, a legal judgment for David may be a good thing for him if she ever does earn money or comes into property or an inheritance.
 
And, to add to what Chase said, in some jurisdictions, verbal agreements can be upheld, depending on what evidence is presented......

It's hard to tell because it's depends on what sort of evidences he has against Kathy and the loan she owes him.


Next time when a person A loans money to person B, type or write on a paper that says, "I promise to pay you ( name of the person A ) $ ( the amount of loan ) and then describes how and when payments are to be due. and have the person B to sign hers/his name, last name and the date, then person A sign it too and then make many copies as they can in case they lost it etc.
