Or a civil union. Nothing prevented him from listing his "lover" as a benificiary though. And he is worried about the car and house???? Gee a simple will from a kit at Barnes & Nobel might have come in handy. In fact had the"lover" been listed on the car and house there would be no question. They would even still be allowed survivor coverage to pay off those notes. Don't have to be married for that. Sounds like they didn't do their homework to me.

When you marry, it takes only $40 to take care of it... tax breaks, inheritance rights, et all.

Gays have to pay taxes, cannot automatically inherit and cannot get benefits automatically.

I mean, seriously, just think of millions of wives that maintain the household and NEVER did anything like that, writing wills and all the steps REQUIRED for a gay couple and if we refused to recognize their marriage, they'd be on the street as well.

Like I said....civil union. That was my first solution. Wills are cheap, some states will allow you to file them for free. It's irresponsible not to have one. Everyone should have a will.

Why can't a simple $40 marriage certificate take care of it?

I do know that in Missouri - they will not recognize a civil union between two peopl of the same sex. Even if they were married legally in another state and re-locate to Missouri - it will not be recognized.

As far as a will - they can do that for property and such, but if the family were to contest the will, then a same-sex partner will usually not win.

The will stands unless they can prove that the person wasn't of sound mind. Wills are legal and binding. A will can cover way more than just property and can include a statement as to why you are distributing the estate the way you have chosen.

Yes same sex marriage is illegal in Missouri. That's why he started the thread saying it should be legal. I merely assert why not civil unions instead.

Well considering the high divorce rate we have now, perhaps we SHOULD force them to start writing wills and contracts with a lawyer to show how serious they are about their relationships instead of a cheap $40 marriage certificate?

Don't know if you can force responsibility. I know I have my paperwork in place as does my daughter. If others don't that's their choice, But, it is pretty irresponsible.

Corporal Engelhard didn't list Glossip as a beneficiary in his will or on his life insurance?

They weren't co-owners of the house?

The car wasn't registered in both names?

At some point during the past 15 years they didn't make sure that each other would be taken care of in the eventuallity that something happened?

Even married couples have to draw up wills to ensure that their property is dispersed according to their wishes.

Married couples also have to get life insurance to provide for their survivors.

One doesn't need to be related by birth or marriage in order to be an insurance beneficiary.

:ty: And in addition, knowing their situation it was probably unwise for him to pay into the pension plan unless he intended to pass those benefits to his son. Better to invest in a way where those funds can go to whomever you choose.
