Police gunfire killed Hofstra University student, official says - CNN.com
New York (CNN) -- A Hofstra University student who died during a confrontation between a home invasion suspect and authorities was killed by police gunfire, a Nassau County, New York, police spokeswoman said Saturday.

Police fired at least eight shots at the intruder, who authorities say was holding a gun to the head of 21-year-old Andrea Rebello during a home invasion robbery Friday at an off-campus house in Uniondale.

One of those shots hit Rebello in the head, killing her, police spokeswoman Maureen Roach said.

Also killed was the intruder, who authorities identified as Dalton Smith, 30, of Hempstead.

Authorities say Smith, who was wearing a mask, invaded the home Rebello shared with her twin sister and two others during the pre-dawn hours on Friday.

At some point, a female roommate of the twins was able to leave the home and call police, a police spokesman told CNN on Friday.

When a police officer arrived, Smith was holding a gun to Rebello's head, Roach said.

He told the officer he was going to kill Rebello, and then turned the handgun toward the officer, she said.

The officer, fearing for his life, drew his gun and fired, Roach said.

Authorities have not identified the officer.

At the time of the shooting, Smith was wanted for jumping parole, police said.

He was on parole for first-degree robbery and had an "extensive" arrest history that includes robbery, assault, and promoting prison contraband, said police in Nassau County.

A warrant for his arrest was issued April 25 for allegedly absconding from parole, police said

Rebello's high school principal, Carol Conklin-Spillane, said the twins' home community in Westchester, New York, was heartbroken.

She described Rebello as a fun-loving, personable and self-aware young woman.

Her parents, Fernando and Nella Rebello, are closely tied to the Portuguese community, and always worked to create opportunities for their children, Conklin-Spillane said.

Rebello, a junior, was majoring in public relations.

that law doesn't work. however - this thread isn't about criminals. it's about police officer killing a civilian in a state where it believes police is people's 2nd amendment.
 
I've been through the training and have a lot of highschool friends who are retired or nearing retirement from the police force...

Their #1 rule is...if a gun is pointed at you, you cover your ass!

Yes, a civilian was killed "accidently" but as an officer, are you supposed to just take a bullet because a criminal had a hostage?

You don't turn, run, screaming like a girl or you get a cap in your hind end. The police officer was doing what he was trained to do, accidents like this happen more often than you think, just because this was on/near campus its making news....because of all the HYPE from all the other college/school shootings....MEDIA ATTENTION GRABBERS !

California has those but caused overcrowded in prison system so agree with Jiro about not work.

Extensive arrest history? It means he had done more than 3 times already and is labeled as career criminals. Career criminals should be in jail til they gets too old to do any criminal activities.

When "a" police officer arrived. I am not saying this tragic outcome would have not happened but there is usually a procedure in place to call for backup immediately. The real story and the one that is reported are two different stories most if not all the time.
The daily list of male violence against women saddens me. Why was this criminal in her home with a gun wrecking her life? What inspires this ongoing insanity and carnage? Women are not evil creatures that deserve all this. It is a disgrace to all men that this goes on.
 
Some people think they can't find felony record of anyone for free. I got it for free, not even a penny paid, just my time to look up. So far Dalton Smith had total of 8 felony records that he was found guilty of.

He was found guilty of

2 class C felony
4 class D felony
2 class E felony

Smith spent in jail from 8/11/2000 to 2/04/2013

Some times at 5 points prison, located southeast of Rochester, NY, and other times at Collins correctional center, I am not sure where it is but can find out but blah.

Some of these felony activities involved firearms.

8 felony charges, only 10 years in prison?

These 8 felonies aren't including his most recent crime activity. Can't charge a dead suspect at all, so can't count that one. :(

After ten years he came out and did what he went in for. This does not include what took place as a juvenile.
I am with diehard on this. It is not a 2nd Amendment failure it is system failure. For all we know the gun he was wielding was hers to begin with.

No murder, no rape, mostly assault, robbery, unlawful possession of firearms. His record still intact after he was released from prison last February. All information is there, except his current address. Reveal of current address only applies to current tier 2 and 3 sex offenders.

I tested the link to see if just URL link will lead you to one of 4 webpages about him, it didn't work. You have to google up "NYS dept Correctional" then click "Inmate lookup" then enter names in field which is Dalton Smith then cross reference with age, he is 30 years old as of this moment. You will then see two names of his, each of them has two recoreds meaning you have to open each of these records which WILL reveal what felony charges are, whether he is currently in custody or already released, and much more information there.

No fee charge for this. The only condition in return is that you have no intention to harass anyone on the record, otherwise you'd be in trouble.

Foxrac, Oh now I got it, yeah murder and sex offense record will show up only when the offender was tried in adult trial. If the offender was tried in jive court then no public record.

In PA, its little different but any offenders in PA won't like this (Worse than NYS) but takes little more work to find out the information. NYS is working on set up similar to PA system.

PA, the inmate look up only works if offenders are still in prison, it only tell you where the offender is staying, ethic, name. No information on what offense it was. To find out what offense the offender had committed, and how long the sentence was? Have to go to PA Unified common plea court website, it is complicated but if you know how it works. It will turn up the court records including charges, and sentencing and more detailed information (OFC, victim information excluded). Once again, no fees required for this one too.

If they're under age, murder or rape doesn't show on their record. Only those crimes committed when they're "adults" will be viewable.

What about charge as adult? Some Juives got charged as adult.

Obviously, he (Smith) was in jive to begin with. He has not learn lesson at all. Sad!

They never do...their world is divided by getting caught and getting away with it. Learning a lesson isn't something that happens in most cases which is why the law needs to be reformed with regard to repeat offenders, no matter what their age.
 
Never is not true. I have seen some cases where they finally learned lesson.

Perfect example, if you remember since your in Massachusetts. That guy did rape and killed two women 30 years ago, and never re-offended and remain quiet on fugitive. He was caught in Maine a month or two ago. He said he has regrets so, "never" is not the case.

I do agree that law needs to be reformed. Jail was meant to teach scumbags hard lesson so that they have the fear of not re-commit.
