Cruel & Unusual Punishment

Viewing child pornography is a passive action. This man was not charged with molestation. He was charged with viewing and having child pornography. He was not charged with producing child pornography. There is no way that he can be charged with doing something violent. To be charged with committing a violent act, he would have had to do something to another directly.
No, it's not the same thing at all.

Yes, but on the other hand isn't viewing child porn a huge red flag? It IS a passive action yes.....but it's still really skivey. It represents violence to children...and someone who gets off on that is seriously mentally distrubed.

Canada too as well. In fact, it was announced today that we've had the lowest homicide rate since 1966. There were 554 homicides committed in 2010.

It is too cold in Canada to commit any crimes!

Really, what is the difference between Canada and USA that would explain the low crime rate in Canada?

Can you give me some examples of difference - pretty pretty please?

Sure. Canadians are, as a whole, more collective than the U.S. In other words, they see the wisdom in looking out for neighbors, etc. Because they see their neighbors as people, they are less inclined to use violence against others. They have also seen the wisdom in the violence begets more violence dictate. They are not afraid of the guy walking down the street because he has a do-rag on. They see him as a human being and treat him as one. They see no need to protect themselves from him, and as a consequence, they don't need to. He was never a threat to them to start with.

Canadians see the good before they look for the bad. In the States, it seems many see the bad and never look for the good. The Canadians seem to live by the dictate of "There but for the Grace of God go I." More empathy.

I am open to corrections or additions from all of our Canadian members, too!:giggle:

It may have something to do with the fact that Canada was a British colony for a long time and was a member of the British commonwealth until the 80s. So, I think the British influence is very much a factor in civility and etiquette.

I would agree. On the whole, the Brits are much more humane and civilized than are Americans.

...As an American who used to live in England, I'm not so sure I'd agree! ...But then, I also caught some anti-American sentiment, thanks to the war.

I think one big factor is what weapons are legal. Another would be what kind of help people who are homeless or impoverished can get. If they can get more help from the government, there's bound to be less homelessness, and they're probably less likely to do things like steal or sell drugs to support themselves. Finally, the kind of support people can get for mental illness could make a big difference as well. In the US, accommodations for the seriously mentally ill are pathetic, so they are extremely likely to a) end up homeless, b) end up in jail, and/or c) end up self-medicating with drugs and/or alcohol.

Right. But having social supports available is a sign of a more humane society, and a sense of responsibility to others. Here is an interesting fact regarding treatment of the mentally ill: in England, the use of 4 point restraints was outlawed in the 18th century. We still use them on a regular basis in the States.

I must commend us all for being rather civilized in this post. This is a very emotional subject. Way to go US!

Yet, like Sunny, I must agree to disagree. Cause/effect. Even if we disagree, I still likes ya. :)

Actually, we are still a member of the Commonwealth of Nations. You may be thinking of the patriation of the constitution.

Cause and effect cannot be determined through correlation. All correlation can say is that the two things are found together sometimes. So, if viewing child porn causes one to molest children, what caused them to have the attraction to the child porn? Obviously, the interest in sexual gratification through under age kids was present, or they wouldn't have been viewing child porn. See how this works out. For it to be cause and effect, the desire and molestation would have had to occur at least once prior to the viewing of and collecting of child porn.

Not say viewing porn cause viewer molest...say viewing porn / creating demand for kiddie porn causes children be molested via creation of porn viewer wants. They may not directly molest themselves, but their action cause molestation happen.

Speaking of Canadians, I've met several. One was my ex daughter-in-law, and we're good friends to this day...Very intelligent, graceful, tactful and a joy to be around!...Wish there more more like her.

[kinda kidding]

Hey, what about micro-chipping repeat sexual offenders- like the ones for pets but it keeps a count of how many/type offenses so that schools, etc could have detectors around...Boop Boop Boop -strobe- Boop Boop Boop *spotlight swings to perv* Boop boop

Got noting useful for drugheads... maybe an insulin pump type of device that doses with an agent that causes stomach distress when 'toxins' are detected... then program for the specific toxins?

[/kinda kidding]

[cynical] Really there's money to be made on both 'wars' (porn/drugs) and the moneymakers do best in a stalemate - not winning as they would lose revenue, not losing so badly that the good guys want the moneymakers to give up... [/cynical]

If I am not mistaken, it has been ruled unconstitutional.

Stupid. Constitutional right child not be rape should far outweigh constitutional right monster raping them.
