Report details alleged assault at MSD - The Frederick News-Post Online

Wrestling and playing around turned criminal last week when a Maryland School for the Deaf student was sexually assaulted with a Mountain Dew bottle and a hand sanitizer bottle, according to charging documents.
Tyler Daniel Dilks, 20, of Whiteford, is one of four male students charged in the Oct. 27 alleged assault. The other three are 17-year-old juveniles whose names have not been released because of their ages. Two are from Baltimore, and one is from Frederick .

They all lived in the Foxwell Moylan Hall dormitory at the school.

The alleged victim, whose name was redacted in court documents, told police the other students held him down on a bed while they assaulted him with the two bottles, the documents state. Sanitizer was sprayed during the assault, causing pain, the alleged victim said.

According to charging documents written by Detective Thomas Tokarz of the Frederick Police Department, Dilks told authorities through an interpreter that "many students were laughing and playing around" before the alleged assault. He admitted to holding the student down and pulling down his pants, but said two other students told him what to do.

One of the teens assaulted the student with the hand sanitizer bottle, according to the documents, and Dilks admitted to inserting the Mountain Dew bottle.

Another student, whose name was redacted, told officers that several boys tried to pull down his pants. He said he hurt his ankle while fighting them off and running away.

The investigation of this alleged assault is continuing, Lt. Shawn Martyak said. It involved some of the same students.

Dilks was a member of the school's 2008-2009 wrestling team, competing in the 285-pound weight category.

School Superintendent James E. Tucker could not be reached for comment Thursday. No lawyer was listed as representing Dilks in the Maryland Judiciary Case Search.

Dilks and the three juveniles have each been charged with fourth-degree sex offense, second-degree assault and conspiracy. The juveniles have been referred to the Department of Juvenile Services. Dilks has a court date set for Jan. 12.


Lawsuit


Dilks is one of 11 students named in a lawsuit filed by Frederick resident Troy Towers, an employee of the school.

The lawsuit, filed in March 2008, claims the students and parents falsely alleged to the Frederick Police Department in 2007 that Towers had sexually abused several students. Towers was charged with second-degree assault, fourth-degree sex offense, minor sex abuse and second-degree child abuse.

Three of the charges were dropped by the Frederick County State's Attorney's Office. The second-degree assault charged was placed on the inactive docket.

The students "entered into an agreement with each other to maliciously, wrongfully, and falsely accuse (Towers) of the various criminal acts," lawsuit documents state. Their conduct "was extreme and outrageous and beyond the bounds of decency in society."

Citing defamation, invasion of privacy, malicious prosecution, civil conspiracy and intentional infliction of emotional distress, Towers wants a jury trial. He is asking for $1 million from each of the 11 defendants and $5 million in punitive damages.

A jury trial has been set for June.
 
I guess this is what happens when children are not properly supervised and brought up under the guidance of loving parents....gotta love those residential schools.

We all dont know what happened and dont have the full story but the point is, it is unfortunate and I hope the perpentrators get punished.

Exactly! Sexual assault only happens at residential schools.:roll: Never, ever is a child ever sexually assaulted by one of their parents.:roll: Never, ever is a student from the public school sexually assualted by a classmate.:roll:

This is a terrible thing. But to place the blame on residential schools is assine.

Sexual abuse HAPPENS EVERYWHERE!!!

If one wants to blame deaf schools, then let's blame public schools, family members, random strangers, and the Catholic churces.
 
I concede (actually, I thought I already had prior to jillio's assinine post about being assinine).

I don't think parents are involved in their children's lives enough these days, and that lends to children acting in the most dispicable ways. Residential school deprives many parents from being active participants in their child's daily lives and lending guidance. Same can not be said for those public school rapists.

Many of these parents cannot communicate with their own children. How can they be the lending guidance? If they arent willing to learn their children's languages then they cant do what to protect them. The residential schools do not deprive them of that..the parents chose that by not learning ASL.

Yeppers. That was my point. Teenagers shouldn't have to be supervised 24/7 just to make sure that they don't commit rape. It isn't about supervision. It is about addressing some very serious issues that these young people have.

When I was in high school, I was unsupervised from the time I got home from school to until 530 PM and then again in the evenings when I would go out with nmy friends.

The point is those boys who committed the crime need to be punished. This is not about the deaf school..it is about those who allegated committed the crime and what prompted them to do something like this. Out of hatred or sickness?

I believe that most of these parents would have the opportunity to LEARN to communicate with their children if it weren't so convenient to ship them off somewhere else. My husband's mother sent him to the state deaf school when he was younger, but couldn't stand the thought of him being so far away from home and being raised by strangers, so she brought him home. She has always communicated with him effectively. She was concerned that the education at the local schools would not be sufficient, but times have changed and that is not as much of an issue now as it once was.

Bingo. The deaf school is quite often the only place they can achieve effective communication.

My husband's mother sent him to the state deaf school when he was younger, but couldn't stand the thought of him being so far away from home and being raised by strangers, so she brought him home. Agreed. These kids not only need punishment and to be made responsible for their actions, they also need treatment. I would say it is a combination of both hatred and sickness.

Given the fact that most deaf kids don't even attend a deaf school as a day student or a residential student, I question that "most" as well. "Most" hearing parents don't learn sign, no matter where their deaf child attends school. And since the LRE determines where a child is educated, unless the parent wants to go through due process, it is not easy to get the home district to send a deaf child to a school for the deaf. It is a battle to get a child sent to a deaf school from the home district.
 
Mind-blowing to me! Pure sadism, sadists....bully-wollies...If something like this happened to one of my sons, I do believe I would commit murder.....and not think twice about it, not even blinking an eye.

I hope the defendant gets every bit of the $1-5 million dollars. But even that cannot compensate what he endured.
