this is getting out of hand...some cops are disgusting and have nothing better to do than pick on ppl and think they can get away with it..
 
Seems reasonable to me. He should have obeyed the instruction, simple as that. If the EMTs or Police either one heard the man make the gun comment then of course the Police have the right to enter without a warrant. In fact they had the right to enter the second 911 was called due to injury.

How can you call yourself a conservative and then condone something like this? The sheriff deputies, as in THE GUBMENT, came into this guy's home, totally uninvited, and starts telling him what he can and cannot do. He did nothing wrong other than to use a little bit of hyperbole to describe the pain he was in. After seeing that he was okay, in no danger to himself or his wife, the pigs should have respected his wishes and left. Just because a cop tells you have to do something, it doesn't mean they have the legal authority to do so, and citizens have the right to question that authority.

I hope this guy sues the sheriff department for all they're worth. Law enforcement in this country needs a huge overhaul.

I think the Dispatcher must have misunderstood what his wife, Pearl, said when she asked for an Emergency paramedics to help her husband after the fall down the stairs. The funny thing is that the EMT did show up and took care of him before leaving his house. But then, the Police had the nerve to show up at his house and tried to arrest him and tazed him if he refused to stand up. Beside he was not feeling well as he wanted them to leave the house, because first of all his wife did not ask for the police. Maybe the Dispatcher had a second thought about the conversation with Pearl and thought the Dispatcher should report to the police.

It happened exactly in another thread about young man calling for an EMT, but the Dispatcher had to call the police instead of EMT. The police tazed his grandmother from her bed. She also did not want them in the house, only the Emergency Paramedics.

So there is something wrong with the Dispatcher sending the wrong message to the wrong people like Police if it is not about crime. Oh, boy, I would rather call the hospital and have them call the Paramedics for us if we get sick or hurt. I would not call 911 for the mistaken from the Dispatcher like that. It is wrong and the Dispatcher should be fire if fatally mistaken in the wrong. :(

1) Police had a right to enter because 911 was called due to an injury.
2) He disobeyed a police order.

As for the rest we will have to wait for both sides to come out. Just like the thread about the little old lady that got tased.......turned out she was waving a knife.

If you go back to that thread you will find it was later posted that the woman was waving a knife. Police are often sent to 911 calls because they can normally get there more quickly. It is common for Police to respond to an injury in a home to ensure there was no domestic violence.

Perhaps "obey a police order and argue about it later" applies out in the streets and in public, but in the privacy of your own home, especially when you have not even called cops, it's not as simple as that. Those cops did not even have the legal right to enter his home. The evidence that he was going to commit suicide was circumstantial. If, upon barging into his house, the cops had asked him if he was going to kill himself, and he made it clear that he was not, that it was just an offhand comment he made, they should have politely left and this whole mess would have been avoided. The heart of the matter is that these pigs were just on a power trip and trying to push someone around, in his own home no less.

They tasered him because they said he was "resisting arrest." Arrest for what? He broke no law and committed no crime. What a load of bullshit, and apparently the judge who threw out the case thought so too.

I'd really like to see how you would have reacted in this same position. It's easy for you to say, "obey the police" from the comfort of your own home, but when the cops come bursting through the door and start telling you they're going to take you away for a 48 hour evaluation or whatever it is, and you don't have a choice, I doubt you're going to just shrug your shoulders and say, "Yeah, sure bub. Let's go. Weee!"

I'm not saying you should fight the police or anything like that, but as an American Citizen, you have rights in your own home, and this guy's rights were trampled all over.

He's already won the case over resisting arrest. I'd say he also stands a very good chance to collect a large sum of deserved cash as well.

That's irrelevant.....if they don't believe him for whatever reason they have to take precautions. He shouldn't have said something so stupid.
 
Ok, tell me how can a healthy strong cop can be threatened by an OLD frail man?!?! I would rather handle him physically than to taze him!

Well, like you said, we need to wait and see the full story come out from both sides before we can determine who it was that was being stupid. I am guessing the guy probably was in a lot of pain and said something like, "Oh man, I wish I had a gun right now so I could shoot myself" or something like that--something meant to illustrate the agony he was in. Whoever misconstrues that as him acting suicidal is the REAL stupid person.

You do realize that the cops will be held liable and can get sued by the family if the man actually commit suicide later on?

Better safe than sorry. I support the cops' action even though the man was joking about "shooting himself in the head w/ gun"

would you still say same if the man made that comment in airplane? for ie... the plane was on stand-by in tarmac for a few hours and he's feeling frustrated.

Why? It wouldn't be their fault if he committed suicide. Nobody is liable in a suicide death. This is basic stuff, dude. Duhhhhhhh.

When I'm on an airplane, I completely agree with the rule of shutting up and doing whatever the cops, or whoever else tells you. They say bend over? You do it, and you do it with a smile on your face. But we're talking about this dude's own private house! C'mon!

wherever you are - you should not be saying something that will give the cops a probable cause to take you in. period.

What you say out of your mouth is what dictates the situation - regardless of where you are. Use your common sense.

Yes the police can be held liable for suicide or violence after the fact.... which means they were there and they were aware of it but they left without taking any action.

Such incident like that - the police officer is then typically placed on suspension or revised duty pending investigation by Internal Affair and independent civil investigation.

you know how it is with public relation. it's brutal. they can't take any chance.
