This is a copy of an email I received from NAD. Thought you all might be interested. Good to know that they are staying on top of ADA violations.


NAD Files Complaint Against DirectBuy

Silver Spring, MD - The National Association of the Deaf (NAD) filed a complaint with the U.S.
Department of Justice against DirectBuy of Metro Washington NW. DirectBuy is a membership-based
sales establishment that claims to allow consumers to purchase brand-name merchandise at
manufacturer-direct prices.

The complaint alleges that DirectBuy refused to provide qualified sign language interpreter services
for a deaf couple who accepted DirectBuy's invitation to attend an informational Open House, in
violation of Title III of the Americans with Disabilities Act (ADA). Instead, DirectBuy sent the
couple a written document entitled "Tour Script for Hearing Impaired." The couple agreed to attend
the Open House with the script and the opportunity to communicate with DirectBuy representatives
without interpreter services. However, if that did not result in effective communication with
DirectBuy representatives, the deaf couple wanted the chance to return for another Open House with
qualified interpreter services. DirectBuy refused to modify its policy limiting attendance to only
one Open House in order to allow the deaf couple a second chance to communicate effectively.

The complaint alleges further that DirectBuy retaliated against the couple for asserting their
rights under the ADA by denying them any opportunity to attend any informational Open House at
all.

"People who are deaf should have equal access to sales establishments and services," said Bobbie
Beth Scoggins, NAD president. "It is hard to believe that we are still facing this kind of kind of
discrimination. What's worse, is that deaf people are being retaliated against and denied any
access when they assert their right to equal access."

The NAD requested that the U.S. Department of Justice investigate this complaint and order DirectBuy
to cease its discriminatory practices and to promulgate written policies to ensure appropriate
auxiliary aids and services, such as qualified interpreter services, are provided.
 
Um... it's not BestBuy... it's DirectBuy.

Oops. Thanks for the correction. Typed the title after I pasted the email. Still and all....good to know that the NAD is staying on top of ADA violations.

Umm, no but I think I am the wrong person to ask this question because I hear well enough. In the membership recruitment meeting, there were only five or six of us in a room about 10 by 10 feet. After we became a member, we were pleasantly surprised that one of the sales associates is an interpreter at her church so we go to her when we order something. The store/warehouse is huge but noise conditions are almost that of a library but it is nice having this lady interpreter, especially for my wife should I go wandering around looking for something while she is poring over catalogs and confidential price sheets and their myriad schemes.

I hope the couple you wrote about get satisfaction.

Yeah, our experience has been satisfactory for all but the issue you have brought up. So who knows what would have happened if we had requested an interpreter. Each DB store is independently owned and their profit margin is slim.

Perhaps this will be a wake up call to all stores operating under the umbrella of DirectBuy.
 
I have heard of this store. Actually, I saw one at a Home Show. The prices are not quite big deal. Many furniture is oversized that do not fix in a standard house. I am not crazy about big stuff.

I think that it is not really necessary to have an interpreter UNLESS a group of deaf customers at the same time and same place, then they must have an interpreter. That would make a sense. For example, I had a small lecture at a hospital with my two deaf friends - with 15 hearing people, and the hospital paid an interpreter for about 300 dollars. I think that it is fair. I know it is cruel.

I don't know what to say about NAD. I believe that NAD made a big mistake. I don't want the company to start hating deaf customers. Many deaf people NEED a job. That's why we have to be careful before we make a choice.

I doubt seriously that an organization such as NAD has made a mistake in the complaints they choose to file. And if you allow them to discriminate against a customer, you can pretty well be guaranteed that they will also discriminate against a protential deaf employee.

I agree that you are right. But, a hearing world is big and a deaf world is small.

Tousi said that the profit margin is slim so that means the company cannot afford to hire an interpreter just for one customer. Is there another way to solve the problem?

I didn't want other companies to hear a lawsuit from a deaf customer or NAD. This is what it made them not to hire deaf people, and I know this is ridiculous for me to say that. All companies should follow the ADA law. Actually, ADA is not for everyone.

I believe that huge companies must obey the ADA law because they have plenty of money.

It reminded me of three elder people (average 70 years olds) that I know and they have one million dollars in their bank. They turn off their furnace in the winter, and they use a flashlight to walk around the rooms at night. I probably think that the elder owners of their company are doing the same thing. It is just unbelievable. Maybe, I would feel like to do the same thing if I have a lot of money. Maybe, the DB lied that their profit is slim. How about if Tousi come to work at night and to find out if the president walks around with his flashlight? :giggle:
