Mom Sues After 5-Year-Old Allegedly Served Long Island Iced Tea

This is another story about a child that has been involved with the alcoholic beverage. I find it surprising that it actually happened in a major restaurant which is Applebee's.

Yeah, That's what I think too. $75k is too much to be asking for but that's what happens once a legal battle starts. The laywer's gonna have a field day over this case.

Yea, sadly I have to agree. It is very unfortunate and it shouldn't have happened at all.
 
I guess it is possible. The bartender poured the premix Tea instead of apple juice. But, $75k is rediculous

I have to admit it was pretty funny...but after that part when she sues the restuant for $75,000...I mean, c'mon...ppl makes mistakes.

well what if her son died, same thing sue this.. cuz of it was very dangerous to lil boy..
 
Another thing, her son didn't know it wasn't apple juice? I would expect by age 5, the son would say "Mom, this apple juice tastes funny". Report doesn't say how much did the kid drink and what the kids alcohol level was.

I can understand that the mother of this 5 years old boy is really upset that they served her son the long island icetea instead of apple juice, I do feel for her as a mother, but suing for 75 thousands is ridiculous, it seem the mother is being too greedy...
 
taste or no taste, the child doesn't know the difference in that taste and what's more the waitress should have been able to idenitfy the drink's difference the LIT is like dark whilist the applejuice is bright brownish yellowish and the smell should also be noticed its acholic drink, however the money that she was suing for is ridculous!

looking for money just cuz of her 5 yr old kid who hasn't yet seen the difference and a child's innocence is tarnished by being exposed to that. the mother IMO should have checked to make sure that it was the correct drink. i always never order drinks from the restruant and bring my own drinks for my kids cuz precatious best than spending money on exorbant cost of drinks. and i think parents go to far with money 75k is dumb in every aspect!

:thumb: I have to agree with Prostock, one would think the child would have told his mom his drink tasted funny, or even the glass they come in. The mom didn't recognize that Long Island Ice Tea comes in a long slim glass, and the apple juice comes in a kiddie cup. Another thing too, whenever we go to Applebee's with my youngest daughter who is 21 years. The server always asks to see her driver's license, so there had to be a mistake there when the drink had been served. I feel so bad for what this little boy had to go through during and after that drink. Now, mom better be more careful and check his drinks before he even picks up the glass. Poor little guy. :(
 
What she’s probably trying to do is intimidate them into settling out of court for about 25 – 30k. This is incredibly common. It’s very often amazingly successful, and I know a bunch of people who have done it. I know a woman who juiced K-Tel Records for 85k after they fired her because she was taking Zoloft. The trick is to go in there huffing and puffing and threatening to sue for megabucks, while all the while negotiating for a much smaller out-of-court settlement.

I agree. Sue high, aim low.

One thing I'd like to disagree on is the amount of the lawsuit. I do not believe that 75k is asking too much. There are a boatload of frivilous lawsuits out there, but I'd classify this one as legit. The kid could have long term effects from it, from organ failure to a variety of other things. Adults bodies handle alcohol much differently than a 5 year olds.

Everyone here at AD was extremely outraged (and rightfully so) with the other story about the uncle who passed out and the toddler got ahold of a drink and was plastered. Why was everyone outraged over that and then say 'Mistakes Happen' when it comes to this story? The story doesn't mention a BAC but the effects were enough that the mother noticed and brought it managements attention (who agreed that it did happen).

I'm 100% against bad lawsuits, but I feel this one is good. I think she will get her 75k, and probably could have sued for a lot more.

I agree with you on this. If you work in a restaurant, you have to know what you are serving your customers, and it was the server's responsibility to know what she was giving the kid. Therefore, Applebee's is probably liable. As for what Prostock said about the child, I agree with that, too. A five-year-old SHOULD know when his apple juice tastes funny.
 
True, any amount of alcohol can harm a child, but this story doesn't fit right with me because kids can be very picky when it comes to food or drinks, so I don't believe one second that a 5 years old will keep drinking something that taste different than an apple juice....He would have told his mom that that this apple juice taste funni, maybe she ignore it and told him to eat, whos know...

I have three kids and they can be quite picky when it comes to food or drink, if something taste funni, they will say something...That's why I'm having a real hard to believing that this 5 years old will actually keep drinking it....

So for the mother suing for 75K? I hope the judge is smart enough to read between the lines....I strongly believe the mother knew that her son was drinking something different than just an apple juice....
 
What a cute boy.

This incident shouldn't have happened, but it did. So mother's got the right to sue, I guess.

Applebee's, so his mom would want to 75Kafter allegely, it's
pretty insane, because it has without proof?? :dunno: I think
his mom is :greddy: their money.
 
I find it hard to believe that a 5 year old boy would keep on drinking the Long Island Iced Tea. It is a strong tasting alcoholic beverage and he could have made a funny face on his look when he first drank it. Also he could have said something about it. I wonder if his mother was ignoring him when he tried to tell her about his drink but I dunno. It is just I find this hard to believe :dunno:
